SUBJECT: ESTABLISHING A POLICY TO IMMEDIATELY FILE INJUNCTIONS IN CASES
OF ORDINANCE VIOLATIONS AND VIOLATIONS OF LAND USE PERMIT

SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS; Refer to Finance Committee and County Counsel to
review costs and procedures for filing immediate injunctions where
there are clear violations of County ordinances or non-compliance
with conditions of ,land use permits.
BACKGROUND INFORMATION: Unless there is a clear indication of a
threat to life or a health hazard providing the same, there are no
provisions in the County ordinances that allow for summarily
abating such a situation. Ordinarily, obtaining a Court injunction
is a time consuming process and often the violator has completed
the offending action. I believe the County should pursue immediate
injunctions to halt work when there is an obvious and purposeful
disregard for County ordinance - such as when our Building
Department has "red-tagged" a project and the construction still
continues.

departments and consultation with County Counsel prior to action being taken; and
REQUESTED staff to review implementation of the citation program.
