SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
Introduce, waive first reading, and set December 4, 1990 for
adoption of Ordinance Amending Ordinance Code Division 526 .
BACKGROUND:
As requested, this office has prepared a proposed ordinance
to amend Ordinance Code Division 526 to reduce or eliminate
potential risks of challenge in a federal court suit on grounds
not related to Division 526 's major purposes .

ORDINANCE NO. 90-
(Amending Division 526 of
the County Ordinance Code)
SECTION I. SM4KARY. This ordinance amends Division 526 of the
County Ordinance Code, to delete the definition of "employee
benefit plan, " and to amend the provision on wages.
SECTION II. Section 526=2.620. of the County Ordinance Code,
defining "employee benefit plan, " is deleted.
SECTION III. Section 526-2. 802 of the County Ordinance Code is
amended to read as follows:
526-2.802 Wages. All construction workers on a major
industrial development shall be paid wages not less than per diem
wages. The total amount of per diem wages shall be paid directly
to each construction worker. If the employer makes employer
payments, the amount paid directly to each construction worker
may be reduced by the amount paid for employer payments provided,
however, that the amount paid directly to each construction
worker shall not be less than the base wage. Per .diem wages
shall be paid from commencement of construction through
completion of construction.
Nothing in this section shall require any employer to make
employer payments or to establish, provide, or fund any. programs
or benefits for which employer payments are paid, nor shall this
section be construed to regulate programs or benefits to which
employer payments are made.

SECTION IV. EFFECTIVE DATE. This ordinance becomes effective 30
days after passage, and within 15 days after passage shall be
published once with the names of supervisors voting for and
against it in the Contra Costa Times, a newspaper published in
this County.
