THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Resolution on November 27, 1990 by the following vote:
AYES: Supervisors Powers, Schroder,.:McPeak, Torlakson and Fanden
NOES: None
ABSENT: None
ABSTAIN: None RESOLUTION NO. 90/759
SUBJECT: Approval of the Parcel Map and Subdivision Agreement for
Subdivision MS 60-84, Walnut Creek Area.
The Public Works Director having notified this Board that the
improvements for Subdivision Ms 60-84, being developed by Russell
W. Glynn have been completed and that such improvements have been
constructed without the need for a Subdivision Agreement;
The following documents were presented for Board approval this
date:
The Parcel Map of Subdivision MS 60-84 , property located in
the Walnut Creek area, said map having been certified by the proper
officials;
A Subdivision Agreement for warranty period with Russell W.
Glynn, subdivider, whereby said subdivider agrees to satisfy any
valid claims of liens of labor and materials as to the said
improvements and subdivision appearing hereafter upon demand by the
county as required in said Subdivision Agreement for Improvement
Warranty within six months from the date of said agreement.
Said documents were accompanied by a letter from the County
Tax Collector stating that there are no unpaid County taxes
heretofore levied on the property included in said map and that the
1990-91 tax lien has been paid in full.
NOW THEREFORE BE IT RESOLVED that said subdivision, together
with the provisions for its design and improvement, is DETERMINED
to be consistent with the County's general and specific plans;
BE IT FURTHER RESOLVED that the improvements have been
COMPLETED as of November 7, 1990 thereby establishing the six-month
terminal period for the filing of liens in case of action under
said Subdivision Agreement:
BE IT FURTHER RESOLVED that the $4030 cash security for labor
and materials (Auditor' s Deposit Permit No. 181344, dated November
6, 1990) deposited by Russell W. Glynn be RETAINED for the six-
month lien guarantee period until May 7, 1991, which time the
Public Works Director is AUTHORIZED to refund the cash security
less the amount of any claims on file.
BE IT FURTHER RESOLVED that said Parcel Map is APPROVED and
this Board does not accept or reject on behalf of the public any of
the streets, paths, or easements shown thereon as dedicated to
public use.
BE IT FURTHER RESOLVED that said Subdivision Agreement for
improvement warranty is also APPROVED.
