RECOMMENDATION:
Amend the Board' s Order of September 18, 1990 making a commitment
of funds from Proposition 134 to the schools and school-related
programs to indicate that it was the intent of the Board of
Supervisors to make the indicated commitment from those funds
provided for in Revenue & Taxation Code Sections 32222 (a) ( 1) and
32230 (b) ( 1) (A) , which would be added by Proposition 134.
BACKGROUND:
On September 18, 1990 the Board of Supervisors approved a report
from the Internal Operations Committee indicating that 30% of the
prevention/education funds from Proposition 134 would be
committed on the basis of average daily attendance for those
school districts which had established a Drug-Free School Task
Force and that 400 of those prevention/education funds would be
committed to programs providing drug abuse prevention and
education services which have direct linkages to the schools.
Subsequently it was recognized that the wording in the
recommendation was not sufficiently precise to clearly reflect
the Board' s intent. Proposition 134 provides for 5 funds, one of
which is the Prevention, Treatment & Recovery Account. This
Account is to receive 240 of the funds raised by Proposition 134.
This Account is, 'in turn, subdivided into four program areas, as
follows:

* Prevention of alcohol and other drug problems. ( 4a of total
funds raised by Proposition 134) .
* Treatment and recovery services for alcohol and other drug
problems. ( 130 of total funds raised by Proposition 134) .
* A coordinated statewide and local training_, public policy
and public awareness program to prevent alcohol and other
drug problems, and to inform the public, particularly
children and teenagers, of the potential health risks of
alcohol and other drug use. ( 20 of total funds raised by
Proposition 134) .
* Capital expenditures ( including accessibility improvements
for the disabled) for housing, treatment and recovery
facilities, domestic violence shelters, and homeless and
low-income facilities for persons recovering from
alcohol-and other drug-related problems. ( 5% of total funds
raised by Proposition 134) .
The only funds which the Board of Supervisors will have available
from this account which can appropriately be allocated to the
schools are those in the first subaccount, entitled "Prevention
of alcohol and other drug problems" . It is the projected
revenue from this subaccount which was used in projecting the
funds which the schools would receive. It is, therefore,
appropriate to amend the Board' s Order of September 18, 1990 in
order to clarify what was intended.

ADOPTION OF A POLICY TO DEDICATE A PORTION OF PROPOSITION 134
SUBJECT: PROCEEDS TO THE SCHOOLS
SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMRNDATIONS:
1 . Agree that if Proposition 134 is enacted statewide, the
Contra Costa County Board of Supervisors will commit any
Prevention/Education funds received by the County in the
following manner:
30% to be allocated directly to the school districts in the
County on the basis of average daily attendance (ADA) ,
as reported to the State Department of Education,
provided the school district has established an active
Drug-Free Schools Task Force.
40% to be allocated to programs that have direct linkages
with the schools.
30% to be allocated for other prevention and education
programs as determined by the Board of Supervisors.
2. Authorize a letter to be signed by all Members of the Board
of Supervisors who wish to do so to the school districts in
the County, Parent Teacher Associations or Parent Clubs, the
California Teachers Association, American Federation of
Teachers and the press advising them of the action taken by
the Board of Supervisors in Recommendation # 1 above.
3 . Authorize the Members of the Internal Operations Committee
to prepare and forward a letter to the statewide campaign in

support of Proposition 134 advising them of the action taken
by the Contra Costa County Board of Supervisors in
Recommendation # 1 above and enclosing a letter which the
campaign in support of Proposition 134 may wish to send to
all counties in California advising them of the action taken
by Contra Costa County and urging that they take similar
action.
BACKGROUND:
As many individuals have observed, a spokesman for the California
Teachers Association has publicly opposed Proposition 134, the
Alcohol Tax Initiative on the basis that it provides no funds for
education programs through the school system. This is at least
misleading, since fully 24% of the funds generated by the Alcohol
Tax Initiative would be dedicated to treatment and
prevention/education programs.
Since most rational prevention and education programs would
involve a partnership with the schools, it appears prudent to
make a commitment in advance of the election that specific funds
will be dedicated in this County to the schools for prevention
and education programs. The allocations suggested . above are
consistent with those included by the Board of Supervisors in
Measure "D" and should help to convince the education community
that, in this County at least, there is a commitment on the part
of the Board of Supervisors to insure that the educational
community participates fully in providing the programs which will
successfully attack the problems of alcohol and drug abuse in
this County.
One of the other recommendations publicizes the -Board's actions
in this regard by advising each school district and PTA/Parent
Club of the Board' s action. The last recommendation provides
this same information to the statewide campaign in support of
Proposition 134 with the suggestion that they provide this
information to each county in California with the suggestion that
each Board of Supervisors take similar action.
