ACKNOWLEDGE RECEIPT OF PETITION REQUESTING AN INVESTIGATION
OF AF.RTAT. SPRAYTNG TN BRENTWOOD AREA
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDED ACTION: Acknowledge receipt of correspondence and petition
from concerned residents requesting an investigation of aerial spraying in
the Brentwood area. Refer this matter to the Environmental Affairs
Committee to consider reports . from the Health Services Department, the
Agricultural Advisory Committee, the Agriculture Department, and the
Community Development Department.
Direct the Community Development Department to notify the Contra Costa
Farm Bureau, the City of Brentwood, Camelia Yarborough-Nunes, Walter
Cannady, local farmers and other interested persons of the date this
matter is scheduled for the Environmental Affairs Committee.
BACKGROUND INFORMATION: I have received the attached
correspondence and petition relative to concerns about aerial
spraying in the Brentwood area. This matter should be scheduled
for immediate review by the Environmental Affairs Committee.
When Camelia Yarborough first contacted my office regarding her
concerns about aerial spraying, my staff referred her to the
Agriculture Department, the Environmental Health Division and the
State Department of Food and Agriculture, Division of Pesticide
Enforcement. A report of findings should be requested from these
agencies.
The Community Development Department should provide the
Environmental Affairs Committee with a report regarding how the
County' s policy requiring deed notification in the agricultural
area is being applied.

Re: Aerial Spray
Dear Sirs:
Please be advised that I represent and I am trying
to help CAMELIA YARBOROUGH-NUNES, who is a resident of the town
of Brentwood, California. Ms . Yarborough-Nunes ' two minor
children, ages 7 and 51 attend school in Brentwood and live
in Brentwood. The two minor children have been experiencing
difficulty with respect to health problems. When Ms.
Yarborough-Nunes took her children t doctor, they were
diagnosed as hav an ov exposure
cider. Ms.
Yarboro nes on h o this further and found
that a cessive amounts r were being sprayed by aerial
sprayi ear the property that she lives on in.
Brentwood, but also close to the school and within more than
one hundred feet of the school where the children attend.
Obviously, Ms. Yarborough-Nunes is extremely concerned with
respect to this matter and accordingly, has talked with various

neighbors and parents of children who have been experiencing
the same type of problems. Accordingly, Ms. Yarborough-Nunes
became more concerned, to her credit as an ordinary citizen,
and circulated the enclosed petitions which have the signatures
of many of the Brentwood and Antioch area people with regards
to aerial spraying.
The thrust of this is that there is a grassroots
movement and many of the local citizens are extremely concerned
with the effects of aerial spraying. This is in no way meant
to stop farming, but only relates to aerial spraying and not
ground spraying. Apparently, helicopters have. been flying and
losing their load of sulfur type products and sulfur based
products, including harmful pesticides, at or near where these
schools are and further, in a vicinity where it is effecting
many of the local citizens . As you can see from .the enclosed,
signed petitions, there is a real problem with the aerial
spraying and the local citizens would like to try to do something
that would alleviate the aerial spraying all together, but not
foreclose the ' farmers from spraying by normal ground methods.
The hazard to the local citizens, as this area has grown and
will continue to grow in population, especially with the
projected population estimates for California, constitutes a
health hazard, not only to the young children, but to the
residents of this area. Even the people who have been with
are extremely concerned, but do not wish to foreclose farmers
from spraying their fields. That is obviously why- the petition
is to aerial spraying only, which seems to diffuse more harmful
and hazardous materials through the air rather than ground
spraying in and of itself. '.
Ms. Yarborough-Nunes, as a concerned citizen and as
a parent, is attempting to take some action, which hopefully
could result in some legislative help, to stop the aerial
spraying, especially within a radius of five (5) miles of
communities the size of Brentwood and which results in a
dangerous condition to all of the parties that live in this
area. I think all of us recognize the fact that many suburban
areas are in fact encroaching upon the farm areas, but it is
felt that both can live in harmony and that is why this is
addressed to aerial spraying.

I am 'enclosing the petitions so that you can see that
there is a definite community interest in trying to alleviate
this problem, which is causing a health hazard. Your kind help
and attention to this problem would be beneficial to your
communities and to the local citizens residing therein. Any
help that you can give Ms. Yarborough-Nunes would be greatly
appreciated. I have enclosed a copy of the Permanente Medical
Group relating to this, as I felt that it should be documented
with respect to this. We do not know whether there is any long
term effects or if there .are any legal .action is going to be
taken at all. However, we feel that the action should be through
the legislature, as that would seem to be more appropriate than
individual lawsuits.
I have been most impressed by Ms. Yarborough-Nunes
interest and dedication to this, as this is the first time that
she has ever been involved in anything along this line and her
interest is not only out of her feelings for the community and
her children, but to try to help the citizens of Brentwood and
the local citizens and the farmers directly. I would hope that
you would give this the consideration that it deserves and take
any action that you feel is appropriate. Ms. Yarborough-Nunes

This letter is to confirm that vp_ have been seeing both boys this sumler in the .
Pediatric and Allergy Clinics for multiple problems since June 30, 1990. Aaron, in
particular, was seen for recurrent and prolonged facial impetigo which seemed to
follow an oral stomatitis. His facial lesions cultured both the bacteria, staph
aureus and the virus, Herpes simplex type 1. Concomitant with this, both boys
were having nasal congestion and nasal lesions with bleeding. Allergy evaluation,
and testing failed to produce an allergic etiology and, infect, there is no
personal or family history of allergies or previous nasal problems.
While there could be multiple explanations for these problems, 'an over-exposure
to pesticides would be logical. This could produce direct mucous membrane and
skin irritation with inflammation, thus setting them up for secondary infections.
Mrs. Nunes report that they worsened after playing outside at home would support
this theory in .light of their symptoms with a negative allergy work-up.

s UNDERGROUND GASOLINE STORAGE TANKS

The American Petroleum Institute(API)estimates that there
'i are hundreds of thousands of underground gasoline storage
tanks throughout the nation. Most were installed in the 1950s
4 and 1960s, a time when the retail gasoline industry was ex-
' panding rapidly. The great majority of storage tanks were con-
structed of steel. These tanks and their pipe connections,
designed to last, at most, twenty years, are subject to corrosion,
and hundreds of leaks have been reported recently.
Between 1977 and 1979, the API canvassed service stations
T
that had reported gasoline leaks. Over 470 leaks were assessed,
304 of which originated in steel tanks;steel piping accounted for
an additional 146 leaks. The API determined that corrosion was
the cause of over 80 percent of the leaks.About 50 percent of the
tanks or pipes found discharging gasoline underground were lo-
cated in sandy soil.
Once gasoline has leached into groundwater,it is extremely
s ; difficult,if not impossible, to completely remove. Gasoline con-
t tamination of an aquifer may render it unusable for decades.
{ o FERTILIZER AND PESTICIDE RUNOFF
4 Agricultural chemicals can pose a major threat to ground-
water. Use of fertilizers to improve crop yields often results in the
R { discharge of excessive levels of nitrogen into the ground(Several
studies have shown that, although plants store large amounts of
? f nutrients during the growing season, they release excessive
amounts to the soil during the nongrowing season. "During the
° nongrowing period, a report on groundwater pollution prob-
lems in the southeastern United States notes,"excess nitrate, as-
sociated with recharge from precipitation, is leached from soil
into the groundwater at high concentrations"27
$ Expanded uses of pesticides and herbicides also subject
groundwater to increased contamination risk. These products
s a� are sprayed on crops,applied directly,or buried in the earth. De-
pending on soil conditions,pesticide and herbicide residues may
leach into the earth and into groundwater supplies. Both farm
and home use of these products present a growing risk to under-
lying groundwater.
