SUBJECT: Hearing on Rezoning Application 02852-RZ to rezone approximately 19.9
acres from General Agricultural District (A-2) to Planned Unit
District (P-1) , subject property fronting for approximately 776 feet
on the west side of Live Oak Avenue, 900 feet south Gumtree Lane, and
opposite the Tate Lane and Live Oak Avenue intersection, in the Oakle
area, filed by Bellecci & Associates (Applicant) and Helen
Bliss/Steiner and Teresa Gosnell (Owners). (APN 041-021-008 and 012)
SPECIFIC REQUEST(S) OR RECOM[ENDATIONS(S) i BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Accept the environmental documentation prepared .for this
project as being adequate.
2. .. 'Approve Rezoning Application 12852-RZ, as recommended by the
East County Regional Planning Commission, along with
Development Plan 3023-90 and Subdivision . 7358 including
attached conditions.
3.1 - ',Adopt the East County Regional Planning Commission's findings
as set forth in Resolution No. 49-1990 as.-the determination
.for these actions.
4. Introduce the ordinance giving effect to the aforesaid
rezoning, waive reading and set forth date for adoption of
same.

The Board on October 16, 1990 closed its hearing on the above
matter and declared its intent to approve on this date the rezoning
and the preliminary development plan, and defer for further discussion
the final development plan and the subdivision approvals.
Karl Wandry, Community Development Department, presented revised
proposed conditions for the rezoning as requested by the Board on
October .16, 1990.
Board members discussed the matter, and as. recommended by
Supervisor Torlakson, IT IS BY THE BOARD ORDERED THAT:
Rezoning 2582-RZ and the Preliminary Development Plan 3023-90 are
APPROVED.
Ordinance No. 90-98 giving effect to Rezoning 2582-RZ is hereby
INTRODUCED, and October 30, 1990 is fixed for adoption thereof.
Decision on Final Development Plan 3023-90 and Subdivision 7358 .
is DEFERRED to December 4, 1990 on the Determination Calendar.

CONDITIONS OF APPROVAL FOR 2852-RZ
1. This approval is based upon the tentative development plan submitted with the
application dated received July 25, 1990, for not more than 42 residential units/lot.
2. The overall density of the development shall be reduced to no more than two (2) units
per net acre unless a suitable park is developed as part of this development. This may
be done in conjunction with neighboring subdivisions if possible, subject to the
requirements of the Oakley Parks Master Plan.
3. The guide for development and use provisions shall be the Single Family Residential
District (R-1 5).
4. Sewage disposal serving the properties concerning in this application shall be provided
by the Oakley Sanitary District. Each individual living unit shall be served by a
separate sewer connection. The sewers located within the boundaries of the
properties concerned shall become an integral part of the Oakley. Sanitary District's
sewage disposal system.
5. Water supply serving the properties concerned shall be by the Oakley.Water District.
Each individual living unit shall be served by a separate water connection: Such water
distribution system located within the boundaries of the properties concerned in this
application shall become an integral part of the Oakley Water District's overall water.

6. Development shall comply with the provisions of the Child Care Facility Ordinance, and
the Transportation Systems Management Ordinance.
