(APN 28-060 -021) SPECIFIC REQUEST(S) OR RECONMENDATIONS(S) i BACKGROUND AND, JUSTIFICATION RECOMMENDATIONS 1. Deny the appeal and Minor Subdivision 119-90, filed by" Lucia Albers (Applicant & .Owner) , as not being consistent with the General Plana F 2. Alternately grant the appeal and approve Minor, Subdivision 119-90; filed by Lucia Albers (Applicant & Owner) , with conditions of approval. BACKGROUND Minor Subdivision #19-90, filed .February 2 , 1990, was denied by the Zoning Administrator July 16, 1990, having parcel size variances to . the Agriculture District A-2 (proposed 2 .5 acres - 5 acres required) inconsistent with the General Plan. This was appealed by the applicant/owner and considered by the East County Regional Planning Commission Board of, Appeals August 27, 1990, at which time a majority- vote- could not be reached. 'i The East County General Plan designates the area of this property for Agriculture/Residential and provides that under exceptional circumstances where a pattern has been established .for parcel sizes of less than 5 acres, then a parcel size related to that pattern may be considered. consistent with the General Plana A parcel size pattern, of less than 5 acres has not been established in the area of this proposal. County Planning Commission acting as the Board of Appeals, of the appeal by Lucia Albers (applicant and owner) from the decision of the Zoning Administrator to deny the applicant' s request to divide 5. 0 acres into 4 lots with variances for average lot width of 2.44: feet for each lot ( 250 feet required) , and lot area, 1. 0, 1.0, 1.0 and 2. 0 acres ( five acres required) (MS 19-90) in the Bethel Island area. Lucia Albers, 1400 Deer Valley Road, Brentwood, applicant and owner, commentedon material she had presented to the Board, including a .letter from her attorney,' •and a letter from members of the East County•General Plan Committee. Ms. Albers also commented qn her proposal creating no impact on the area, and her previously approved vesting tentative map.l Karl Wandry, Community Development Department, presented the staff report on the matter before the Board, describing the site location, a brief history of the proposal, and advised that this project, in staff' s interpretation, is inconsistent with the General Plan. Lucia Albers spoke in rebuttal. II The public hearing was closed. } ;i Supervisor Torlakson moved to deny .the appeal based on .the staff 's review and the General. Plan. Supervisor McPeak advised that this project is contraryjto the Specific Plan. i Karl Wandry clarified that the project 'is not consistent with the 1978 General Plan as written relative to ag residential requirements for subdivision :less .than five acres. Victor Westman, County Counsel, clarified the meaning of a vesting tentative map. i The Board discussed the matter.
