Approve revised guidelines governing membership and requirements
for Redevelopment Project Area Committees.

BACKGROUND/REASONS FOR RECOMMENDATIONS
California Community Redevelopment Law (Health and Safety Code
Section 33000 et seq) contains the requirement for, establishing a
Redevelopment Project` Area Committee (PAC) and the qualifications
for membership on a PAC.
On July 11, 1989, tike Redevelopment Agency adopted Project Area
Committee Guidelines, The purpose of these Guidelines is to
provide an organizational framework for the administration of the
PACs pursuant to Health and Safety Code 33386.
Staff is recommending the Guidelines (Exhibit A) be revised to
reflect a two (2) year term of appointment to a PAC, with the
exception of newly forming committees in which half of the members
will serve an initial term of three (3) years. Each member's
initial term shall expire on June 30th, following the first full
term of service (2 years, or 3 years for newly formed PAC members) .
Subsequent terms stall expire two years thereafter on ea h

A Redevelopment Project Area committee (PAC) is required by California Commmity
Redevelopment Law (Health and Safety Code Section 33000 et. seq.) when "a
substantial number of low- and moderate-income families are to be displaced by
the redevelopment project." However, the Board of Supervisors may choose to
form a PAC when not required by State law. The Board of Supervisors appoints
residents and members ofiexisting community organizations in a redevelopment
project area to the PAC. Tine PAC includes "residential owner occupants,
residential tenants, businessmen and members of existing organizations within
the project area." "Businessmen" includes non-resident property owners. An
attempt will be made to Jequalize representation among organizations. A PAC
will not exceed twelve (12) members, including ex-officio, non-voting members.

All potential PAC members must submit an application to th Supervisor whose
district includes the redevelopment project area. The Supervisor than appoints
members to the PAC.
PAC members serve without cc apensation. PAC members. will be reimbursed for
incurred Committee expenses only with prior approval by Redevelopment Agency
staff.

The PAC will meet a m n'm' mt of four times per year (once per quarter) .
Additional meetings may be scheduled by staff in consultation with the PAC
chairperson.
PAC meetings fall under the Brown Act which, in part, stipulates:
1. There must be a 72 hour advance notice of all meetings.
2. All meetings must be open to the public.
3'. A meeting notice must be posted for the general public.
A RedevelopmentAgency's staff person will serve as secretary to each PAC.

Committee members who miss more than two meetings per calendar year may be
replaced.
Committee members must contact their PAC chairperson or Redevelopment Agency
staff person when they caniot attend the meeting.
All PAC votes are subject to a quorum which is defined as one more than half of
the voting members. The voting outcome represents a simple majority of members
present.

Political reform laws prevent PAC members from casting votes when they have a
conflict of interest. Conflict of interest is defined as a PAC member who will
have a financial gain from the outcome of the decision he/she would be
participating in. PAC members are required to complete a Statement of Economic
Interest upon appointment land annually thereafter. Failure to complete this
Statement will result in removal from the PAC.

Term of appointment to a PAC shall be for two (2) years, with the exception of
newly forming committees in which half of the members will serve an initial term
of three (3) years. Eadx member's initial term shall expire on June 30th,
following the first full term of service (2 years, or 3 years for newly formed
PAC members) . Subsequent, terms shall expire two years thereafter on each
successive June 30th. Nothing precludes the reappointment of a PAC member.
The maxim= term of office for the chairperson shall be two years. Nothing
precludes, however, reelection of the chairperson by a majority vote of PAC
members.

PAC Member Resignations
PAC members must resign ifthey:
1. Move out of the redevelopmentproject area;

2 Fail to completejthe Statement of Economic Interest; or
3. Cease to a) own property in the project area;
b) operate a business in the project area; or
c) be a member of an existing organization within the
pr Ject area.
