RESOLUTION NO. 3596
RESOLUTION APPROVING SUPERSEDING PART I AND NEW PART II
OF SECTION 81HOUSING CERTIFICATE PROGRAM ANNUAL
CONTRIBUTIONS CONTRACT NO. SF-468
AND AUTHORIZING EXECUTION
BY THE EXECUTIVE DIRECTOR
WHEREAS, the Housing Authority of the County of Contra Costa ("PHA")
entered into a Section 8 Annual Contributions Contract ("ACC") on
November 12, 19751, as amended, with the United States of America
("Government") ; and,
WHEREAS, The Section 8 ACC must now be revised so that it will consist of
the following counterparts:
a. Superseding Part I of the ACC, HUD 52520B (August, 1988) ,
applicable to the Section 8 Existing Housing Certificate
Program; III

b. New Part I of the ACC, HUD 52520E (June 1985) , applicable
to Section 8 Existing Housing Certificate Program and
Section 8l Existing Housing Voucher Program:
NOW, THEREFORE, BE IT RESOLVED BY THE PHA as follows:
1. The SUPERSEDING Part 1 Section 8 ACC and the New Part II of
the ACC for the Housing Certificate Program and the Housing
Voucher Program afire hereby approved and accepted. The Executive
Director of the Hiousing Authority of the County of Contra Costa is
hereby authorized and directed, on behalf of the Board of
Commissioners, to execute the counterparts of the ACC on behalf of
the PHA, and is hereby authorized to impress the official seal of
the PHA on each such counterpart and to forward such executed
counterparts to the Government together with such other documents
evidencing the approval and authorizing the execution thereof as
may be required by the Government.
2. This resolution shall take effect immediately.

AND AUTHORIZING EXECUTION BY THE EXECUTIVE DIRECTOR
I. RECOMMENDED ACTION:
ADOPT Resolution No. 3596 approving amendment to the Section 8 Housing
Certificate Program Annual Contributions Contract SF-468 and AUTHORIZE execution by
the Executive Director of thelHousing Authority of the County of Contra Costa, as
recommended by the Advisory Housing Commission.
II. FINANCIAL IMPACT:
Seventeen percent (17%) of the total Section 8 Existing Housing contracts
administered by this Housing Authority is represented by the 624 Section 8 units in
the Annual Contributions Contract expiring on November 11, 1990.
III. REASONS FOR RECOMMENDATION/BACKGROUND:
In April of 1989 HUD granted an extension of the Annual Contributions Contract
covering the first increment of Section 8 units allocated to the Housing Authority.
This extension expires on November 11, 1990. HUD has notified us that the
replacement funding for our expiring Section 8 Certificates will be made in Federal
Fiscal Year 1991 appropriations. However, because replacement funds may not be
received early enough to avoid delays in processing the funding requisitions, HUD has
requested the following actions:
1. Housing Authorities should consider requesting their Board of Commissioners
to delegate to the Executive Director the authority to execute Section 8
ACC amendments which provide replacement funds and/or extend the term of
the contract.
2. Housing Authorities should make sure to submit all required financial
documents, budgets and requisitions to HUD at the same time they return the
executed Annual Contributions Contract.
At its Regular Meeting 1n Monday, October 15, 1990 the. Advisory Housing
Commission voted to recommendiadoption .of Resolution No. 3596 approving amendment to
the Section 8 Certificate Program Annual Contributions Contract Sf-468 and authorize

execution of the amendment by the Executive Director of the Housing Authority once a
legal opinion has been received from County Counsel determining that no state or
local lawsexist which would prohibit the delegation of the authority.
We have now received an` opinion from County Counsel that no state or local
laws exist which would prohibit the delegation of authority for execution of an
amendment to the Annual Contributions Contract to the Executive Director of a
Housing Authority by its Board of Commissioners.
IV. CONSEQUENCES OF NEGATIV1E ACTION:
Should the Board of Commissioners elect to not adopt Resolution No. 3596
approving the amendment to the Annual Contributions Contract SF-468 and authorizing
execution by the Executive Director, rental assistance to 624 low-income families
would be delayed, thereby creating chaos for the tenants, property owners and Housing
Authority.
