HomeMy WebLinkAboutMINUTES - 10161990 - 1.4 1.: THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on October 16, 1990 by the following vote: AYES: Supervisors Schroder, McPeak, Torlakson and Fanden NOES: None ' ABSENT: Supervisor Powers ABSTAIN: None RESOLUTION NO.90/681 SUBJECT: Approval of the Final Map, Subdivision Agreement and Drainage Improvement Agreement for Subdivision 7330, Oakley Area. The following documents were presented for Board approval this date: The Final Map of Subdivision' 7330, property located in the Oakley area, said map having been certified by the proper officials. Said Map was accompanied by: I. A Subdivision Agreement with Hillside Park Partners, A California Limited Partnership, subdivider, whereby said subdivider agrees to complete all improvements as required in said Subdivision Agreement within one year from the date of said agreement. Said agreement was accompanied by security to guarantee the completion of road and drainage improvements as required by Title. 9 of the County Ordinance Code, as follows: A. Cash deposit (Auditor's Deposit Permit No. 179756, dated October 1, 1990) in the amount of $8,700 made by California Homes. B. Additional security in the form' of a corporate surety bond dated September 27, 1990, and issued by Developers Insurance Company (Bond NO. 202994 S) with Hillside Park Partners, A California Limited Partnership as principal, in the amount of $866, 000 for faithful performance and $437, 350 for labor and materials. II. A Drainage Improvement Agreement with Hillside Park Partners, A California Limited Partnership, subdivider, whereby said subdivider agrees to complete all 'improvements as required in said Drainage Improvement Agreement within one year from the date of said agreement. Improvements generally consist of Constructing the off-tract storm drain system. Said agreement was accompanied by security to guarantee the completion of drainage improvements as required by Title 9 of the County Ordinance Code, as follows: A. Cash deposit (Auditor's Deposit Permit No. 179756, dated October 1, 1990) in the amount of $8, 800, made by California Homes. B. Additional security in the form of a corporate surety bond dated September 27, 1990, and issued by Developer's Insurance Company (Bond NO. 202995 S) with Hillside Park Partners, A California Limited Partnership as principal, in the amount of $869,500 for faithful performance and $439, 150 for labor and materials. Letter from the County Tax Collector stating that there. are no unpaid County taxes heretofore levied on the property included in said map and that the 1989-90 tax lien has been paid in full and. the 1990-91 tax lien, which became a lien on the first day of. March, 1990, is estimated to be $1, 700. IV. Security to guarantee the payment of taxes as required by Title 9 of the County Ordinance Code, in the form of a surety bond, No. 202919 S issued by Developer's Insurance Company with Hillside Park Partners, a California Limited Partnership as principal, in the amount of $1,700 guaranteeing the payment of the estimated tax; NOW THEREFORE BE IT RESOLVED that said subdivision, together with the provisions for its design and improvement, is DETERMINED to be consistent with the County's general and specific plans. BE IT. FURTHER RESOLVED that said Final Map is APPROVED and this Board does not accept or reject on behalf of the public any of the streets, paths, or easements shown thereon as dedicated to public use. BE IT FURTHER RESOLVED that said Subdivision Agreement and Drainage Improvement Agreement are also APPROVED.
