Costa County Sanitary Landfill SPECIFIC REQUESTIS)OR RECOMMENDATION ISI&BACKGROUND AND JUSTIFICATION RECOMMENDATION Authorize the Director of Community Development to manage the preparation of an Environmental .Impact Report for the State's Department of Health Services (DOHS) for the closure of the hazardous waste .unit of the West Contra Costa Sanitary Landfill, subject to the terms. of the May 16, 1989, Memorandum of Understanding between the Board of Supervisors and the . State Department of Health Services. FINANCIAL IMPACT None. The cost of preparing the Environmental Impact Report would be borne by the landfill operator (Richmond Sanitary Service) . BACKGROUND State and regional - agencies in recent years have arranged for the Community Development Department to manage the preparation of Environmental Impact Reports for some of their "projects" under circumstances where the projects are located in. Contra Costa County but when they are the Lead Agencies for CEQA purposes and the County has no discretionary approvals. If there were County discretionary approvals, the state and regional agencies would. prefer to defer to the General-purpose local unit of government for EIR preparation. Recent examples of EIR's the County has prepared for other agencies are the EIR's for the DOW Hazardous Waste Incinerator (for DOHS) and for a set of co- generation facilities (for the Bay Area Air Quality Management .District) . Arrangements have been made for. the Community Development Department to prepare the closure plan EIR for the IT Vine Hill-Baker facility, which DOHS now expects to get underway in early 1991. The West Contra Costa Sanitary Landfill hazardous waste unit closure project EIR would be similar to the IT closure project in many respects. (via CCD) Richmond Sanitary Service BY 4— DEPUTY Among the reasons for the state and regional agencies to have the County manage the preparation of certain of their EIR's are the Community Development Department's familiarity with a broader range of local environmental issues that could result from the projects and the Community Development Department's greater experience with the CEQA process. A benefit to the County's citizens is the opportunity to ensure that the broader range of issues are addressed in the resulting EIR's. DOHS informally approached the Community Development Department on this matter approximately two years ago, but the landfill's closure plan was not ready to be evaluated. DOHS now expects the plan to be submitted in early 1991, and sent a letter of request to the Board of Supervisors on August 7, 1990 asking for Board authorization. The Community Development would be able to devote the moderate amount of time needed to oversee the EIR's preparation, and is agreeable to again serving as the management agency. Subsequent to the initial contact, the County and DOHS developed a Memorandum of Understanding for the managementof the EIR's for DOHS in connection with Preparations for the IT closure plan EIR. The Board approved the Memorandum of Understanding on May 16, 1989. Since the terms of the Memorandum of Understanding are generic, it is proposed to apply it to the program for preparing the West Contra Costa Sanitary Landfill hazardous waste disposal unit closure plan EIR.
