SUBJECT: Proposed Response to the Report of the 1989-90 Grand Jury:
"Juvenile Detention Facilities"
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. - Adopt this report of our Committee as the Board of Supervisors' response to
the Report of the 1989-90 Grand Jury: "Juvenile Detention Facilities."
2. Request County Administrator to advise the Juvenile Justice/Delinquency
Prevention Commission and employees of the Probation Department that the
Board of Supervisors does currently have possession of the report of Peat
Marwick Main, and will release the report as soon as it is released by the
Grand Jury and becomes ,public information.
3. Remove this item as a referral to our Committee.
BACKGROUND
On June 12', 1990 the 1989-90 Grand Jury submitted the report entitled "Juvenile
Detention Facilities" which was subsequently referred to the Internal Operations
Committee. On September 20, 1990 our Committee met to discuss the recommendations
and review proposed responses. At the conclusion of these discussions we prepared
the attached response utilizing a format suggested by a previous Grand Jury which
requested that responses clearly specify:
A. Whether the recommendation is accepted or adopted;
B. If the recommendation is accepted, a statement as to who will be responsible
for implementation and a definite target date;
C. A delineation of constraints if a recommendation is accepted but cannot be
implemented within the calendar year; and
D. The reason for not adopting a recommendation.
Responses to Grand Jury recommendations coming from our Committee will follow this
format as closely as possible.

Questions have been raised of Board Members by members of the Juvenile
Justice/Delinquency Prevention Commission and individual employees of the
Probation Department regarding why the Board of Supervisors would not release the
management audit completed by Peat Marwick Main. The forewoman of the 1990-91
Grand Jury advised our Committee on September 20, 1990 that the Grand Jury has not
yet received the report from Peat Marwick Main. She indicated that as soon as the
Grand Jury receives the report they will take appropriate actions in as
expeditious a manner as possible. The County Counsel s Office indicated to our
Committee that the report is the property of the Grand Jury and the Board of
Supervisors cannot gain access to the report until it is released to the Board of
Supervisors by the Grand Jury.

JUVENILE DETENTION FACILITIES
Recommendation No. 1
The County Administrator provide funding for an outside, independent,
full-management audit of the Contra Costa County Probation Department to be
supervised by the Grand Jury.
Response
A. This recommendation was adopted.
B. On May 22, 1990 the Board of Supervisors authorized the County. Administrator
to meet with the Presiding Judge of the Superior Court and the Juvenile Court
Judge in relation to this request. On May 29, 1990 Peat, Marwick Main and
Company agreed to conduct for the Grand Jury a management review of the
Probation Department focusing on the juvenile and institutions aspects of the
department. The Grand Jury is awaiting receipt of the final report.
