SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION
Introduce the ordinance amending Ordinance Code Chapter 84-63 Land Use Permits
for Development Projects Involving Hazardous Waste or Hazardous Materials, waive
reading and fix October 9, 1990 for adoption.
FISCAL IMPACT
None.
BACKGROUND/REASONS FOR RECOMMENDATION
The Board of Supervisors referred to the County Hazardous Materials Commission
the review of Chapter 84-63 of the County Ordinance Code (Ordinance 86-100) .
This -Chapter requires land use permits for specified development projects
involving hazardous waste. or hazardous materials in the L-I, Light Industrial;
W-3 , Controlled Heavy Industrial; and H-I, Heavy Industrial Land Use Districts.
The Hazardous Materials Commission has completed their review of this Chapter,
and recommends that the Board adopt the amendments to County Ordinance Code
Chapter 84-63 which are included in the attached proposed ordinance.

The amendments include the following:
1. to emphasize that the purpose. of County Ordinance Code Chapter 84-63
is to protect public. health, safety and general welfare;
2 . to amend the definition of a "development project" to include projects
with specified engineer designed capacity, to add that the use of
transportable treatment units may constitute a "development project",
and to add that pipelines and related equipment, maintenance, ,repair
or minor augmentation of existing equipment do not constitute a
"development project" ;
3 . to amend the definition of a "substantial expansion" to add that the
use of a transportable . treatment unit may constitute a substantial
expansion, and to add that pipelines and related equipment,
maintenance, repair or minor augmentation of existing equipment do not
constitute a "substantial expansion" ;
4 . to delete pipelines and related equipment, maintenance, repair or
minor augmentation of existing equipment as exemptions and to add as
an exemption projects with a design capacity in excess . of the
threshold amount specified in this chapter if the applicant
. demonstrates that the amounts actually managed will be below the
Chapter's thresholds;
5. to provide for an application to the Community Development Department
Director for a determination as to the Chapter's applicability;
6. , to specify the conditions under which the Zoning Administrator may
issue a Certificate of Exemption;
7 . to add the requirement. of public notice and hearing before granting
an exemption.
