HomeMy WebLinkAboutMINUTES - 01301990 - T.8 T. 8 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on January 30, 1990 by the following vote: AYES: Supervisors Powers, Schroder, McPeak, Torlakson and Fanden NOES: None ABSENT: None ABSTAIN: None --------------------------------------------------------------------- SUBJECT: Hearing On Appeal By DeBolt Civil Engineering And Bill Hayes On Minor Subdivision 32-89 In The Danville/Tassajara Area. This is the time heretofore noticed by the Clerk of the Board of Supervisors for hearing on the appeal by DeBolt Civil Engineering and Bill Hayes (appellants) from the decision of the San Ramon Valley Regional Planning Commission upholding the decision of the Zoning Administrator denying the request by DeBolt Civil Engineering (applicant) and Bill Hayes (owner) for approval of a Minor Subdivision (MS 32-89 ) to subdivide a property into two parcels with variances to minimum parcel dimension requirements in the Danville/Tassajara area. Mary Fleming, Community Development Department, presented the staff report on the appeal, describing the project site, and giving a brief history of the request. She commented on the Planning Commission' s recommendation for denial and on the staff recommendation that the Board deny the appeal filed by the applicant and sustain the denial decision of the San Ramon Valley Regional Planning Commission. The public hearing was opened and the following person appeared to speak: Brian D. Thiessen, P.O. Box 358, Danville, representing Bill Hayes, spoke in favor of the appeal, commenting on issues including the appropriateness of the variance request, surrounding parcel sizes, utilities capacities, the suitability of the site for urban residential density, and changes in the area since the Zoning Administrator' s hearing. He also commented on annexation to the Town of Danville and the lack of opposition to the proposal. He requested that the Board grant the appeal subject to the conditions that the staff has set forth and affirm the negative environmental impact report. The public hearing was closed. Supervisor Schroder commented on changes in the area since the area Planning Commission hearing, the annexation to the Town of Danville, and the supplying of water to the area. He also advised of the Town of Danville' s intent to annex the Lawrence Road area, that the Town of Danville is not opposed to Mr: Hayes lot split, and that it is the Town' s intention to rezone the properties in this area to one acre R-40 . Supervisor Schroder moved to declare intent to grant the appeal filed by the applicant and overrule the denial by the San Ramon Valley Regional Planning Commission and to have staff prepare findings for adoption next week. IT IS BY THE BOARD ORDERED that the Board DECLARES intent to grant the appeal by DeBolt Civil Engineering from the decision of the San Ramon Valley Regional Planning Commission on Minor Subdivision 32-89; and Community Development Department is DIRECTED to prepare the appropriate documentation for Board consideration on February 6, 1990 calendar.
