SUBJECT: Hearing on Rezoning Application #2850-RZ, to rezone acres roml
Multi-Family Residential (M-29) to Planned Unit District (P-1) ,
located at the southeast corner of Pacific Avenue and Anchor Drive in
the West Pittsburg area, filed by New Century Construction (Applicant)
and North Bay Development, Inc. (Owners) (APN 098-362-001)
SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1, Accept the environmental documentation prepared for this
project as being adequate.
2. Approve Rezoning Application #2850-RZ, along with Final
Development Plan #3024-89 and Subdivision 7374, as recommended
by the East County Regional Planning Commission, including
conditions attached. (Exhibit A attached)
3 . Adopt the East County Regional Planning Commission' s findings
as set forth in Resolution No. 53-1989, as the determination
for these actions.
4. Introduce the ordinance giving effect to the aforesaid
rezoning, waive reading and set forth date for adoption of
same.

This being the time heretofore noticed by the Clerk of the Board of Supervisors
for hearing on the above matter, Mary Fleming, Community Development Department,
presented the staff report . The public hearing was opened and no one appearing
in opposition, the public hearing was closed. On recommendation of Supervisor
Torlakson, IT IS BY THE BOARD ORDERED that recommendations 1 , 2 , 3, and 4 , are
APPROVED; and as in recommendation 4, Ordinance No . 90-4 is INTRODUCED, reading
waived,.and February 6 , 1990 is set for adoption of same .

CONDITIONS OF APPROVAL FOR FINAL DEVELOPMENT PLAN 3024-89 AND SUBDIVISION 7374
1. This application is approved based on the preliminary plans submitted to
the Community Development Department dated received September 8, 1989. The
following conditions must be met prior to filing the Final Map unless
otherwise indicated.
2. The total number of lots shall not exceed 9,. excluding the remainder.
3. Should archaeological materials be uncovered during grading, trenching or
other on-site excavation(s) , earthwork within 30 yards of these materials
shall be stopped until a professional archaeologist who is certified by the
Society for California Archaeology (SCA) and/or the Society of Professional
Archaeology (SOPA) has had an opportunity to evaluate the significance of
the find and suggest appropriate mitigation(s) , if deemed necessary.
4. Prior to the issuance of building permits the applicant shall submit
frontyard landscape plans for each lot. Landscaping materials shall be in
accordance to County Water Conservation Policies.
5. All landscaping shall be constructed and maintained by the applicant prior
to occupancy of each unit.
6. The applicant should provide solid fencing on the sides and rearyards of
each parcel . Fence plans shall be subject to final review and approval by
the Zoning Administrator.
7. Il.luminated house numbers visible from a public or private roadways are
required for each residence.
8. The applicant shall verify that sewer and water service is available.
9. The applicant shall comply with the conditions of the following agencies:
A. Comply with the requirements of the Building Inspection Department.
B. Comply with the requirements of the Riverview Fire Protection Dis-
trict.
10. Comply with drainage, road improvement, traffic and utility requirements as
follows:
A. In accordance with Section 92-2.006 of the County Ordinance Code, this
subdivision shall conform to the provisions of the County Subdivision
Ordinance (Title 9) . Any exceptions therefrom must be specifically
listed in this conditional approval statement. Conformance with the
Ordinance includes the following requirements:
1. Constructing road improvements along the frontage of Anchor Drive
and Pacifica Avenue. The existing frontage improvements con-
sisting of curb, gutter and sidewalk satisfied this requirement.

2. Additional street lighting is not required. This property has
already been annexed to County Service Area L-100 for maintenance
of street lights.
3. Undergrounding of all utility distribution facilities. An ex-
ception to this requirement is granted for the existing struc-
tures.
4. Conveying all storm waters entering or originating within the
subject property, without diversion and within an adequate storm
drainage facility, to a natural watercourse having definable bed
and banks or to an existing adequate storm drainage facility
which conveys the storm waters to a natural watercourse. Con-
structing drainage improvements subject to the review and ap-
proval of the Flood Control District will satisfy this require-
ment.
5. Designing and constructing storm drainage facilities required by
the Ordinance in compliance with specifications outlined in Di-
vision 914 of the Ordinance and in compliance with design stan-
dards of the Public Works Department.
6. Submitting a Final Map prepared by a registered civil engineer or
licensed land surveyor.
7. Submitting improvement plans prepared by a registered civil en-
gineer, payment of review and inspection fees, and security for
all improvements required by the Ordinance Code or the conditions
of approval for this subdivision. These plans shall include any
necessary traffic signage and striping plans for review by the
County Traffic Engineer.
8. Applying for encroachment permits from the Public Works Depart-
ment, Engineering Services Division, for driveway connections
within the right of way of Anchor Drive.
9. Installing, within a dedicated drainage easement, any portion of
the drainage system which conveys run-off from public streets.
B. Prevent storm drainage, originating on the property and conveyed in a
concentrated manner, from draining across the sidewalks and driveways.
C. Furnish proof to the Public Works Department, Engineering Services
Division, of the acquisition of all necessary rights of entry, permits
and/or easements for the construction of off-site, temporary or per-
manent, road and drainage improvements.
D. Prior to issuance of building permits, file the Final Map for Subdi-
vision 7374.

ADVISORY NOTES
A. The applicant shall comply with the Park Dedication Ordinance.
B. The applicant will be required to comply with the requirements of the
Bridge/Thoroughfare Fee Ordinance for the West Pittsburg Area of Benefit
and the East/Central County Travel Corridor Area of Benefit as adopted by
the Board of Supervisors.
C. The applicant will be required to comply with the drainage fee requirements
for Drainage Area 48B as adopted by the Board of Supervisors.
D. Certain improvements required by the Conditions of Approval for this de-
velopment or the County Subdivision Ordinance Code may be eligible for
credit or reimbursement against said fee. The deveioper 'should contact the
Public Works Department to personally determine the extent of any credit or
reimbursement for which he might be eligible.
