THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Resolution on January 30, 1990 by the following
vote:
AYES: Supervisors Powers , Schroder, McPeak, Torlakson & Fanden
NOES: None
ABSENT: None
ABSTAIN: None
RESOLUTION NO. 90/70
SUBJECT: Completion of Improvements for LUP 2129-87, Walnut
Creek area. Assessor's Parcel 184-312-024
and 025.
The Public Works Director having further notified this Board
that the improvements for LUP 2129-87 have been completed as
provided in the Road Improvement Agreement with Somar
Construction Company heretofore approved by this Board;
Somar Construction Company has requested an eighty-five
percent performance bond reduction for the duration of the one
year warranty period, in accordance with section 94-4.406 of the
ordinance code.
NOW THEREFORE BE IT RESOLVED that the improvements have
been COMPLETED as of January 30, 1990 thereby establishing the
six-month terminal period for the filing ,of liens in case of
action under said Road Improvement Agreement:
BE IT FURTHER RESOLVED that the $8,900 cash security for
labor and materials (Auditor's Deposit Permit No. 149291, dated
December 6, 1988) deposited by Somar Construction Company be
reduced to $2,500 and RETAINED for the six- month lien guarantee
period until July 30, 1990, at which time the Public Works
Director is AUTHORIZED to refund the cash security less the
amount of any claims on file and the Public Works Director is
AUTHORIZED to refund the remaining amount of $6,400 plus interest
in accordance with Government Code Section 53079, if appropriate,
to Somar Construction Company.
BE IT FURTHER RESOLVED that the $17,800 cash security for
performance (Auditor's Deposit Permit No. 149291, dated December
6, 1988) is reduced to $1, 000 and the Public Works Director is
AUTHORIZED to refund to Somar Construction Company the remaining
$16,800 plus interest in accordance with Government Code Section
53079, if appropriate;
BE IT FURTHER RESOLVED that the beginning of the one year
warranty period is hereby established, and the $1, 000 cash
deposit (Auditor's Deposit Permit No. 149291, dated December 6,
1988) made by Somar Construction Company be RETAINED for one year
pursuant to the requirements of Section 94-4.406 of the Ordinance
Code.
