SUBJECT: Transfer Station Rates and Status of Landfill Closure
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION
Adopt rate application procedures, rate setting policies and per ton rates for
the Acme Interim Transfer Station as recommended by Deloitte & Touche. Accept
the report on the status of closure plans for the East County and West County
landfills.
FINANCIAL IMPACT
None to the County. The rates apply to the users of the interim transfer
station.
BACKGROUND/REASONS FOR RECOMMENDATION
Interim Transfer Station Rates - At the January 16, 1990 meeting, the Board
requested further information on operating ratios appropriate for the interim
transfer station. Deloitte & Touche has prepared an analysis of operating
ratios as requested by the Board. It should be emphasized that the recommended
operating ratio reflects recommended rate setting policy of guaranteed cost
reimbursement for the life of the interim transfer station. This guaranteed
cost reimbursement reflects the anticipated short life of the interim transfer
station and acknowledges the importance of the transfer station for the export
agreements.
Landfill Closure Plans - The California Integrated Waste Management Board is the
regulatory agency governing the submittal and funding of closure and postclosure
plans for landfills. Under State regulation, the Richmond Sanitary Landfill and
East Contra Costa Landfill were required to submit preliminary cost estimates
for closure of the landfills. The cost estimates were $12.8 million and $11.3
million, respectively.
In December, the Waste Management Board adopted new regulations on closure and
postclosure. Those regulations cover the contents of the closure and
postclosure plan as well as required mechanisms of financial assurances. State
staff has informed us that letters are in the process of being mailed to
landfill operators requiring revision of financial assurance mechanisms in
accordance with the new State regulations and certification that the cost

In approving the recommendation above, the Board also approved a $52. 22 per
ton rate for the Acme Interim Transfer Station allowing the applicant a
93 . 4% operating ratio , with a 37-month amortization of capital .

estimates are accurate. Responses will be required by March 1, 1990. In addition,
the State regulations require filing of a final closure and postclosure plan two
years prior to the anticipated date of closure or July 1, 1990 if the landfill is
anticipated to close on or before September 28, 1992. In addition, preliminary
closure and postclosure plans are required at the time of application for a solid
waste facility permit review (required every five years) .
It is Staff's understanding that the East Contra Costa Landfill has not
submitted a preliminary closure plan. For the Richmond Sanitary Landfill, the
City of Richmond is in the process of hiring consultants to analyze the closure
plan (developed approximately five years ago) for adequacy under the current
regulations.
