Approve the formation of the Local Coordinating Committee as outlined in the attached transmittal from the Superintendent of Schools pursuant to Penal Code Section 13864 as amended by AB 1087 (Chapter 92, Statutes of 1989) . 2. Indicate that it is the Board of Supervisors intent in approving the formation of the Local Coordinating Committee that such Committee shall have no jurisdiction over the implementation of SB 2599 (Chapter 983 , Statutes of 1988 ) , except as the Health Services Director may request the advice and input of the Local Coordinating Committee. 3 . Indicate that it is Board of Supervisors intent in approving the formation of the Local Coordinating Committee to express no opinion regarding whether the Local Coordinating Committee should also perform those functions outlined in Health & Safety Code Section 24168 .1 as added by AB 75 (Chapter 1331 , Statutes of 1989 ) but that the Board specifically intends that the Local Coordinating Committee not have any jurisdiction over nor responsibility for any other aspect of the implementation of AB 75, except as the Health Services Director may specifically seek advice from and coordination with the Local Coordinating Committee. BY M382 (10/88) BACKGROUND: - On December 21, 1989 the Board of Supervisors withheld its approval of the Local Coordinating 'Committee established pursuant to AB 1087 (Chapter 92 , Statutes of 1989) and requested that staff from the Health Services Department discuss the situation with the County Superintendent of Schools. The Board' s concern was that neither the Drug Program Administrator nor the Alcohol Program Administrator were included in the membership of the Local Coordinating .Committee. Attached is a copy of the report this office made to the Board of Supervisors on December 21, 1989 which provides additional background on this and related legislation dealing with drug program funds. Dr. Stewart has now modified the composition of the Local Coordinating Committee to include both Jerry Nava, Alcohol Program Administrator and Chuck Deutschman, Drug Program Administrator. Attached is a copy of the revised membership. Stewart, Ed.D. , Superintendent of School for Contra Costa County, recommending that the Board of Supervisors approve the composition of a Local Coordinating Committee of specified membership. As a result of a telephone conversation with Dr. Stewart, he has clarified that he is also recommending that the community input provided to his office for purposes of implementing one _ specific section of AB 75, dealing with the tobacco prevention provisions funded by Proposition 99 as they apply to the Superintendent of Schools, be combined under the auspices of the Local Coordinating Committee required by AB 1087 . Urgency legislation was signed into law by the Governor on July 5, 1989. This legislation is AB 1087 (Chapter 92, Statutes of 1989) . AB 1087 amended legislation (AB 198 , Chapter 83 , Statutes of 1989 ) which created in the Office of Criminal Justice Planning the Comprehensive Alcohol and Drug Prevention Education Program. This Program is intended to funnel to County Superintendents of Schools certain specified funds which are designed to supplement the Suppression of Drug Abuse in Schools Program. The Superintendent, in turn, forwards these funds to individual school districts . AB 1087 changes the name of this program to the Comprehensive Alcohol and Drug Prevention Education component of the Suppression of Drug Abuse in Schools Program. 2_ , In order to receive funds under this program, the County Superintendent of Schools must meet certain requirements of the law, including the following: "Each county superintendent of schools shall establish and chair a local coordinating committee to assist the superintendent in developing and implementing a countywide implementation plan. This committee shall include the county drug administrator, law enforcement executives, school district governing board members and administrators, school faculty, parents, and drug prevention and intervention program executives selected by the superintendent and approved by the county board of supervisors" (emphasis added) . Legislation was also enacted in 1988 in an effort to bring alcohol and drug planning more closely together. This legislation, SB 2599 (Chapter 983, Statutes of 1988) , requires the County' s alcohol advisory board and drug abuse advisory board to meet together at least twice a year and urges that the County prepare a five year drug and alcohol master plan. SB 2599 recommends, but does not require, the formation of a multidisciplinary drug and alcohol abuse advisory body. SB 2599 requires, if such an advisory body is formed, that "The membership of the local advisory body is representative of the county' s population, geographically balanced, and consists of representatives of each of the following: (A) Law enforcement. (B) Education. (C) The treatment and recovery community, including a representative with expertise in AIDS treatment services. (D) The judiciary. (E) County alcohol and drug administrators or their designees. (F) Student groups. (G) Parent groups. (H) Private industry. ( I ) other community organizations involved in drug and alcohol services. " Dr. Stewart ' s letter references SB 2599. However, in talking with him this afternoon, he indicated that we should ignore that reference, since it was not his intent to involve his office in the responsibilities to implement SB 2599 , which are clearly the responsibility of the County Health Services Department. . , -3- Dr. Stewart' s letter also suggests that this same Local Coordinating Committee administer the provisions of AB 75 (Chapter 1331, Statutes of 1989) , which appropriates the cigarette tax funds from Proposition 99. - (Although not specified, - it is our understanding that this reference to AB 75 is specifically to Chapter 1.2 (commending with Section 24160) which was added to Division 20 of the Health & Safety Code by AB 75 and which deals with Tobacco Use Prevention. We would draw the Board of Supervisors' attention to the following comments which staff would make in regard to Dr. Stewart' s letter: 1 . The Local Coordinating Committee is required to include the county drug administrator. There is some confusion as to who that individual is since it was Dr. Stewart' s understanding that that individual was Stuart McCullough, whereas Chuck Deutschman is generally understood to be the Drug Program Administrator. We would recommend that the Board authorize the Health Services Director to designate. who that individual will be and that the list provided by Dr. Stewart be amended to simply refer to the County Drug Administrator without reference to a specific individual. It is our understanding that the Health Services Director would also like to have the County Alcohol Administrator added to the Committee. Dr. Stewart has indicated that he has obtained an extension of time until January 19, 1990 to submit the membership for the Local Coordinating Committee. If the Board of Supervisors is not satisfied with the membership of the Committee the Board may wish to simply withhold their approval of the Committee and ask the Superintendent to meet with the Health Services Director to alter the membership of the Committee and return a revised membership to the Board on January 16, 1990. 2. It is recommended that any Board Order approving the Local Coordinating Committee not make any reference to AB 75 since the Board of Supervisors is not required to approve the mechanism which the Superintendent uses to provide input for the tobacco education education responsibilities he has pursuant to Health & Safety Code Section 24168 .1 as added by AB 75 and that the Board' s Order specifically indicate that the approval of the Local Coordinating Committee does not imply that the Board of Supervisors is delegating any responsibility to the Superintendent to implement any aspect of SB 2599 . With these stipulations, we believe the Board of Supervisors can approve the membership of the Local Coordinating Committee. We would note that the Board of Supervisors does not appear to have any authority to change the membership of the Committee as presented by the Superintendent, simply to approve or not approve the membership which is presented to the Board. County Health officials and Z have agreed to a collaborative comprehensive approach in implementing the requirements of these billsi and therefore, have combined the LCC' s memberships into one committee . The LCC is to assist me in developing the county--wide plan for submission by: Providing technical assistance to the individual school districts and to the county superintendent; Reviewing and advising in the development of the county-wide plan and budget prior to submission; and Assisting the superintendent in ensuring that -all individual school districts and consortium of school. districts receive their prescribed allocation as approved by OCJP. Additionally, the County Board of Supervisors is required to approve the LCC appointments for a two-year term. Authorize the County Administrator to prepare a letter for the signatures of the Chair of the Board and the Chairman of the Media Committee, Chuck Latting, inviting the media in the Bay Area to one of two meetings called to explain the importance of the media in furthering the County-wide Drug and Alcohol Action Plan. The agenda for such meetings would include discussing the role for the media which is contained in the Action Plan and determining the willingness of the media in the Bay Area to commit their time and resources to furthering the Action Plan as is outlined on page 19 of the Action Plan as considered by the Board of Supervisors on January 16, 1990. 2. Authorize the Health Services Director to schedule two meetings with the media: one in San Francisco with executives from the Bay Area electronic media and the San Francisco print media and a second meeting in Contra Costa County with the media in the East Bay. These meetings are to be scheduled at times when all members of the Board of Supervisors are available so that those who wish to attend can do so. The Action Plan outlines actions which various elements of the community can take to assist in attacking the drug and alcohol abuse problem in this County. Actions are outlined for parents, families, youth and students, schools, employers, labor unions, service clubs, neighborhood associations and many similar segments of the population, including the media. The involvement of the media is considered critical because the media have a significant impact on the lives of many residents of this County, primarily in terms of the type of information that is imparted to the community, the type of entertainment which many of us watch or listen to and the type of advertising to which we are exposed. How the media handle each of these responsibilities can influence how the community thinks and acts. Certainly, how the use of drugs and alcohol are portrayed on television and radio, how news stories dealing with the manufacture, sale and use of illegal drugs are handled and the types of alcoholic beverage advertising which the media accepts all have an impact on how the community views the use of illegal drugs and the illegal use or abuse of alcoholic beverages. A number of meetings are already underway with a number of these segments of the community. The Board of Supervisors has met with school district officials and reviewed the Action Plan with them. Each of the regions in the County has a regional steering committee which is refining the Action Plan as 'it applies to their region. Several cities have already undertaken a variety of efforts in support of the Action Plan. Private businesses, represented by the chambers of commerce, have reviewed the Action Plan for how it would apply to them. The police chiefs in the County have reviewed the Action Plan and have recommended steps which law enforcement should take in support of the Action Plan. We are suggesting that the Board of Supervisors undertake a similar set of meetings with the media in the Bay Area. It should be emphasized that these meetings are not intended to publicize the Action Plan or the Conference with the general public. The meetings are intended to review the Action Plan with the media representatives and determine the level of concern they have with the drug and alcohol problem in this community and what commitment they are able and willing to make to assist the County in implementing those portions of the Action Plan which are particularly relevant to the media. Because we want to involve the general managers of the San Francisco-based television stations as well as executives from the San Francisco-based radio stations and newspapers, it is believed to be important to set up one meeting with them in San Francisco since it is unlikely that they will come to Contra Costa County for such a meeting. A second meeting is being suggested for those radio stations and newspapers which are based in Contra Costa County and the Oakland-East Bay area. This meeting would be held in Contra Costa County.
