BACKGROUND: Each month the County's Construction Manager for the West County Justice Center and Martinez Detention Facility, O'Brien-Kreitzberg & Associates, Inc. files a progress report with the County on the;work they are supervising on the construction of the West County Justice Center and the Main Detention Facility in Martinez. Progress Report# 15 for November, 1989 notes,in regard to the West County Justice Center that in addition to the 23 calendar day time extension already granted, an additional 10 day time extension has been negotiated and will be recommended for County approval. The report also notes that Changes and Potential Changes equal 68%of the $1.58 million contingency, leaving a balance of $499,006 and that the Contractor's level of productivity has improved as a result of an increased labor force and changes to the sequence of work. In regard to the Main Detention Facility in Martinez, the Progress Report notes that Contract Documents Phase began in April, 1989 and that 90%complete contract documents were received by the County on August 18, 1989. The report also notes that design review backlog with the Department of Correction is delaying final completion of the design contract documents. This review is currently 60 days behind the project schedule. In addition, the report notes that the project is currently projected to be over budget by $290,000. INTRODUCTION: This report is subdivided into three major sections: 1) Executive Brief and Summary, 2) Detailed Schedule and Financial Information and 3) Attachments. It describes the design and construction progress for the West County Justice Center, Marsh Creek Detention Facility and Martinez Detention Facility achieved during the period of September 1989 as well as Areas of Concern. B. GENERAL: 1. West County Justice Center a. Revised Environmental Impact Report The administrative draft of the EIR was received on October 24. The draft was distributed to the Sheriff's Department, Community Services Department, County Counsel and Justice System Programs office for review. Comments are due November 3. b. Design• The 1007 complete signage contract documents were received on September 28. The County continues to review the 907 complete furniture plans, final comments will be issued in early November. b. Construction: 1) Contract A: Substantially complete. 2) Contract B: Construction contract critical activity were construction of the remaining second floor masonry walls and the roof at the Administration Building and roof installation at the Housing Buildings No. 6, 7 and 8. MAJOR AREAS OF CONCERN: 1. West County Justice Center: ♦ Contract B: Walsh Construction Company a. County Code Interpretation of Fire Ratings: Issue: The Contractor is preparing a claim for indirect and delay costs associated with the time required to resolve issue and implement solutions required by the County Code inspector's interpretation of the fire rating of the mechanical shafts in the housing units. Action: The Construction Manager has put the Contractor on notice that his pricing is delinquent. b. Termination of Kitchen Equipment Subcontractor: Issue: The kitchen subcontractor was terminated by the contractor for non-performance. The Contractor has negotiated subcontractors with a new kitchen equipment suppler and installer. The supplier is Rycoff, and the installer is West Coast Refrigerator. Action: The Construction Manager directed the Contractor to submit a revised schedule for the delivery and installation of the kitchen equipment for the Construction Manager's review and analysis. C. Fire Damper Support: Issue: The State Fire Marshal requested information concerning the framing of the openings for the fire dampers. Action: Information was gathered by the Construction Manager and forwarded to the Fire Marshal. The Fire Marshal reviewed the information and agreed to allow the installation of the fire dampers to continue in accordance with the contract documents. d. Inspection of Electronic Equipment: Issue: On October 31, representatives from the County, Architect, and Construction Manager traveled to Thorn Electronics for preliminary inspection of the electronic equipment. The designers noted one minor change they would like to institute. Action: The Construction Manager will analyze the cost and time impact of this change and will present this issue to the County for direction. Perimeter Electronics System: Issue: The Architect and the electronics consultant reviewed the perimeter electronic system on October 20. Two problems areas were noted, one at the southwest corner of the site, and one at the sallyport. Action: The Architect will issue an RFI directing changes to correct these areas. The Construction Manager will process the Request to the Contractor and will negotiate the change. The nature of the corrections were reviewed with the Sheriff's Transition Team. f. Curb Claim: Issue: The Construction Manager issued his final decision on the roof equipment base support claim. The Construction Manager agreed with the Contractor that the metal stud supports were an addition to the scope of work but requested a credit for the tee beams which were a reduction in the Contractor's scope of work. The Contractor is not in agreement with the credit request. Action: The Contractor has issued his formal notice of claim and is to follow with detailed documentation. g. Deck Opening Claim: Issue: The County -issued its final decision on this dispute denying the claim. The Contractor has filed the notice to litigate. Action: The Contractor may litigate after County acceptance of the contract. h. Toilet Accessory Claim: Issue: The County issued its final decision on this issue denying the claim. The Contractor has notified the Construction Manager that it intends to litigate. Action: The Construction Manager will maintain files supporting the claim denial. The Contractor may litigate after County acceptance of the contract. i. Seamless Flooring: Issue: The Contractor has issued a claim that the seamless flooring was incorrectly specified as a sole source item. Action: The Construction Manager issued a final decision denying the claim. -7- CONTRA COSTA COUNTY J USTICE P R O G R A M PROGRESS REPORT NO. 15 OCTOBER 1989 Contract B: Walsh Construction Company(Cont'd) j. Security Grilles in Building 1: Issue: The Sheriff has requested security grilles in 32 rooms in Building 1. The Construction Manager analyzed the impact of these grilles and estimated the cost could be as much as $100,000 and the time as much as a two week extension of the project. Action: The Construction Manager has set up a meeting with the Architect and Sheriff to develop alternate solutions to this problem. k. Security Fence Fabric: Issue: The Sheriff has requested a meeting with the Security Consultant since they are concerned with the specified non-climbable fabric. Action: Meeting was held on October 5. The Security Consultant is to describe a test of the system. 1. Multiplicity Claim: Issue: The Contractor has verbally claimed that due to the number of changes and clarifications they have been impacted (multiplicity) financially and in time. Action: The CM will request that the Contractor put their claim in writing so that detailed schedule and cost analysis can be requested from the Contractor. It is the CM's interpretation that the contract prohibits multiplicity claims. M. Schedule: Issue: The Contractor's progress has slipped the last two months and instead of being ahead of schedule, they are on the brink of falling behind schedule. Action: The Contractor's delays are due to a lack of manpower for electronics, HVAC and plumbing which is delaying follow-on trades. GENERAL: The detailed schedule report is subdivided by three projects: 1) West County Justice Center, 2) Marsh Creek Detention Facility and 3) Martinez Detention Facility. The three projects are further divided into the design and construction phases. The design portion will include general design data and a progress narrative. The construction section will be subdivided by each contract and will provide contract data, a progress narrative, plus a bar chart. 2. West County Justice Center a. Design: The status for ongoing design phase is: Equipment - Complete. Signage - Complete. Furniture - 90% complete, County reviewing documents - Final submittal anticipated in November b. Construction: The West County Justice Center project includes two contracts: 1) The first contract was for the rough grading of the project site (Contract A), which is substantially complete. 2) The second is for the construction of the detention facility (Contract B). PROGRESS NARRATIVE The rate of construction showed signs of improvement during October. The typical crew sizes increased by almost 507 from 90 to 130. In addition, the practice of working crews sequentially through the buildings has been stopped and crews are working in parallel to make up lost time. The current most crucial activity is communication wiring and terminations. That crew has been increased by 507. Another crucial activity is electrical wiring and termination and that crew is working Saturdays to make up lost time. PROGRESS NARRATIVE (Cont'd) a. Building One (Administration Building): The work is behind schedule. The current critical activity is the communication wiring and terminations. The rough-in work is substantially complete and most of the gypsum wall .board has been installed. b. Building Two (Medical/Dental/Library/Classroom Building): The work is on schedule. The current critical activity is the duct work; however, the follow-on activity, partition walls, has already started. C. Building Three (Multi-purpose Building): The work is on schedule. The current critical activity is duct work, - but as with Building 2, the follow-on activities have started. d. Building Four (Intake Housing/Central Visiting): On schedule. The current critical activity is duct work, which is scheduled for completion in early November. e. Building Five (Inmate Housing): Behind schedule. The current critical activity is core area electrical and communication wiring and termination. These activities are scheduled for completion in early November. f. Building Six (Inmate Housing): Behind schedule. The current critical activity is communication wiring and termination. That activity is scheduled for completion in late December. g. Building Seven (Inmate Housing): . Behind schedule. The current critical activity is communication wiring and termination. That activity is scheduled for completion in late December. h. Building Eight (Inmate Housing): Behind schedule. The critical activity is communication wiring and termination. That activity is scheduled for completion in January. 3. PROGRESS BAR CHART: A progress bar chart is included to this report (Attachment D). It compares the actual physical progress of field activities to their scheduled progress. Martinez Detention Facility a. Design The proposed design/bidding schedule is as follows: Design Review/estimate: August 29 Bid opening: October 31 Award: November 21 Notice to Proceed: December 4 Plans were distributed to the Board of Corrections, State Fire Marshal, Building Inspection Department, Consolidated Fire District and Sheriff's Department for review. These reviews are taking 30 to 60 days longer than scheduled due to current backlog with some of the reviewing agencies. This review delay has impacted upon the procurement schedule. General: The detailed financial report is divided into three projects: 1) West County Justice Center, 2) Marsh Creek Detention Facility and 3) Martinez Detention Facility. The projects are further divided into the Design and Construction phases. The Design portion will include a narrative. The Construction section will be subdivided by each contract and will provide contract data, where available, narratives and cost curves. 2. West County Justice Center a. Design: The Architect's basic fee is $2,494,423 of which $2,306,869 (92%) has been paid. In addition, the Architect has been authorized $608,276 for extra services, of which $536,709 (88%) has been paid. b. Construction: The West County Justice Center financial report includes two contracts: 1) The first contract was for the rough grading of the project site (Contract "A") which is substantially complete.
