SUBJECT: APPROVING FIRST AMENDMENT TO CONSULTING SERVICES AGREEMENT FOR
ARCHITECTURAL SERVICES FOR REMODELING 100 37TH STREET & 100 38TH
STREET, RICHMOND (0928-WH240B)
SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION
I. RECOMMENDATION
A. APPROVE the First Amendment of the Consulting Services Agreement
with Fox Design Group for Remodeling at 100 37th Street & 100 38th
Street, Richmond, for Bay Judicial District.
B. AUTHORIZE the Director of General Services to execute the Amendment
and to issue written authorizations for extra work, provided that
the cumulative total extra cost for all such authorizations shall
not exceed $25,000 . 00. The Amendment will be effective January 23 ,
1990 and will include modifications in the project scope, an
increase in the Fixed Limit of Initial Construction Contract Cost,
an increase in the Payment Limit for Consulting Services, and the
addition of an indemnification clause regarding asbestos
activities.
II. FINANCIAL IMPACT
This Amendment will increase the encumbrance for basic architectural
services from $38,500. 00 to $83 ,743 . 00. There are sufficient funds in
the plant acquisition account for this project to cover the
encumbrances.
III.REASONS FOR RECOMMENDATIONS/BACKGROUND
A. On September 13 , 1988, the Board approved a Consulting Services
Agreement dated August 22, 1988, with Fox Design Group, Pleasant
Hill, for full architectural service. The Consultant has found
that the original scope of work for the remodeling at 100 37th
Street, Richmond must be expanded to meet current code requirements
for fire safety and accommodation of the disabled. This Amendment
will modify the project scope and will change the Fixed Limit of
.Initial Construction Contract Cost from $385,000. 00 to $761,307. 00
to reflect these code requirements. Also, the Amendment will
increase the Payment Limit for Consulting Services as described in
Section II above so that -the Consultant can be fairly compensated
for the changes in project scope.

CONSULTING SERVICES AGREEMENT FOR January 23, 1990
ARCHITECTURAL SERVICES FOR
REMODELING 100 37TH STREET &
100 38TH STREET, RICHMOND
B. The County has found asbestos containing materials in certain areas
to be remodeled. In general, architects and general contractors
cannot obtain insurance coverage for services or work related to
asbestos activities. Consequently, the County has retained
specialists to remove the asbestos containing materials. This
Amendment will add an indemnification clause to hold the Consultant
harmless from claims and damages resulting from work related to
asbestos activity.
