Return to: Public Works Department Records Section ._` THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on January 9, 1990 by the following vote: AYES: Supervisors Powers , Fanden, Schroder, McPeak & Torlakson NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO.90/14 ` SUBJECT: Completion of Improvements, and Declaring Certain Roads as County Roads, Approval of the Road Improvement Agreement for Warranty, LUP 2008-85, Rodeo Area. The Public Works Director has notified this Board that the improvements for LUP 2008-85 have been completed and that such improvements have been constructed without the need for a Road Improvement Agreement, and an agreement for the warranty of the improvements for one year is presented for Board approval. A Road Improvement Agreement for Warranty with Thomas F. Gozzano and John M. Donkonics, developer, whereby said developer agrees to warrant all improvements as required in said Road Improvement Agreement for Warranty within one year from the date of said agreement. Improvements generally consist of frontage improvements on San Pablo Avenue, Parker Avenue and Rodeo Avenue. Said document was accompanied by the following: Security to guarantee the warranty of road and drainage improvements as required by Title 9 of the County Ordinance Code, as follows: A. Cash deposit (Auditor's Deposit Permit No. 166318, dated December 15, 1989 in the amount of $1,000 made by John Donkonics and Thomas F. Gozzano. B. Letter of credit dated December 14, 1989, issued by The Mechanics Bank (letter of credit No. 1585) with John Donkonics and Thomas F. Gozzano, as principal in the amount of $31,300 for labor and materials. C. Letter of credit dated December 14, 1989, issued by The Mechanics Bank (letter of credit No. 1586) with John Donkonics and Thomas F. Gozzano as principal, in the amount of $8,390 for faithful performance and maintenance. NOW THEREFORE BE IT RESOLVED that the improvements in the above-named development have been COMPLETED as of January 9, 1990 thereby establishing the six-month terminal period for the filing of liens. BE IT FURTHER RESOLVED that the widening of San Pablo Avenue, Parker Avenue and Rodeo Avenue are ACCEPTED and DECLARED to be County Roads; the right of way was conveyed by separate instruments, recorded on November 18, 1988, in Volume 14725 of Official Records on pages 357, 358 and 359. BE IT FURTHER RESOLVED that said Road Improvement Agreement for Warranty is APPROVED. RESOLUTION NO. 90/14 r BE IT FURTHER RESOLVED that the aforesaid letter of credit (No. 1585) for labor and materials be RETAINED for the six-month lien guarantee period until July 9, 1990, at which time the Public Works Director is AUTHORIZED to exonerate the letter of credit if no claims are on file, or to draw on the letter of credit in the amount of any claims on file. BE IT FURTHER RESOLVED that the beginning of the one year warranty period is hereby established, and the aforesaid $1,000 cash deposit and letter of credit (No. 1586) be RETAINED for one year pursuant to the requirements of Section 94-4.406 of the Ordinance Code. 1 hereby certify that this is a tru6 and correct copy of an action taken and entered on the minutes of the Board of Supervisors on the date shown.
