This is the time heretofore noticed by the Clerk of the Board of Supervisors for hearing on the appeal by Vincent McClun (appellant) from the decision of the San Ramon Valley Regional Planning Commission serving as the Board of Appeals sustaining the decision of the Zoning Administrator on the request by Vincent McClun (applicant) and Paul and Loretta Wilhelmsen (owners) for a minor subdivision (MS 106-88) to divide ' l . 5 acres into two parcels with a subsequent request for an exemption from the "collect and convey" drainage requirements in the Alamo area. Karl Wandry, Community Development Department, presented the staff report on the matter before the Board. He presented a brief history of the appeal before the Board describing the proposed project site. He commented that the issue was not the subdivision itself but rather the collect and convey requirement. Supervisor Schroder requested clarification of the drainage requirements. Milt Kubicek, Flood Control, responded to Supervisor Schroder' s question.. . The public hearing was opened and the following persons appeared to speak: Vince D'Alo, Aliquot Associates, representing the applicant, requested consideration of the appeal and presented a brief history of the matter. Scott Finn, 315 Diablo Road #100, Danville, representing Finn Development, spoke in favor of proposed drainage. The public hearing was closed. Milt Kubicek expressed concern in terms of an exception to the collect and convey requirements because it is. used Countywide to require that adequate drainage infrastructure be installed as a part hof the development process. He commented on problems involved if rainage is not required as a part of the development process. Supervisor Schroder expressed agreement with Mr. Kubicek relative to the County policy, but expressed concern about the prohibitive cost of improvements and advised he would like to defer the decision to confer with Mr. Kubicek on the drainage, work out something that is not punitive, and he moved to defer the decision on this matter for two weeks. The Board discussed the issues relative to the collect and convey requirement. Supervisor Torlakson commented on the drainage problems in East County.
