SUBJECT: Conflict of Interest Code for the Contra Costa Delta
Highway Joint Powers Financing Authority.
SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
Approve Conflict of Interest Code of the Contra Costa Delta Highway
Joint powers Financing Authority as adopted by the Board of
Directors of the Authority.
FISCAL IMPACT
None.
BACKGROUND/REASONS FOR RECOMMENDATIONS
The Contra Costa Delta Highway Joint Powers Financing Authority was
.formed by a Joint Powers Agreement (JPA) between the Cities of
Antioch and Pittsburg and Contra Costa County, executed for the
purpose of financing the construction of a westbound lane on State
Route 4 over the Willow Pass grade.
Through the JPA, the Authority is empowered to make and enter into
contracts, employ agents and employees, meet and discuss issues
affecting the project, incur debts, liabilities and obligations,
and sue and be sued in its name. Based on the powers given the
Authority by the JPA, Counsel determined that the Authority is a
local public agency which possesses decision-making authority. As
such, the Authority must adopt a conflict of interest co e.

Counsel prepared a draft conflict of interest code which was
brought before the Board of Directors of the Authority for
consideration. A public hearing was held on November 13, 1989 to
receive comments on the draft code. No comments were received and
the code was adopted by the Board of Directors.
Prior to instituting the Code, the Authority must submit the
adopted Code to the Board of Supervisors for review and approval.
The Board of Supervisors is the code reviewing body for local
government agencies as provided for by State Law. The Community
Development Department provides administrative staff to the
Authority and is forwarding this Code to the Board of Supervisors
on the Authority' s behalf .
CONSEQUENCES OF NEGATIVE ACTION
Failure of the Contra Costa Delta Highway Joint Powers Financing
Authority to adopt a conflict of interest code will place the
authority in violation of Government Code sections 87300-87312,
which require every local government agency to adopt a conflict of
interest code.
