SUBJECT: APPROVING AND AUTHORIZING EXECUTION OF CHANGE ORDER NO. 1 TO VI.+11 'ty
CONTRACT FOR ABATEMENT OF SOIL AND GROUNDWATER CONTAMINATION AT
999 BLANCHE LANE, LAFAYETTE, CA (AUTHORIZATION NO. WH305A,B)
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
I. RECOMMENDATION
APPROVE Change Order No. 1 to the Contract dated September 5 , 1989,
for Abatement of Soil and Groundwater Contamination at 999 Blanche
Lane, Lafayette, California, with Aqua Science Engineers, Inc. , and
AUTHORIZE the Public Works Director to execute the Change Order, which
provides for a $300,000 increase in the Guaranteed Maximum Cost,
required to compensate the Contractor for actual amounts expended in
doing work which could not be anticipated when the contract was
executed, plus not more than 15 percent to cover profits and
administration, pursuant to Public Contract Code Section 20134.
II . FINANCIAL IMPACT
Fundin2__will be from Road Fund accounts of the Public Works Department.
III . REASONS FOR RECOMMENDATION/BACKGROUND
A. On September 12 , 1989, the Board found that an emergency existed
and authorized the Director of General Services to proceed, in
the most expeditious manner, pursuant to Public Contract Code
Section 20134, with abatement of contaminated soil and
groundwater caused by leaking fuel tanks at the Public Works
Department Corporation Yard at 999 Blanche Lane, Lafayette.
B. A contract for abatement of contaminated soil and groundwater was
executed with Aqua Science Engineers, Inc., of San Ramon,
California, with an effective date of September 5, 1989. Payment
under the contract was based on time and materials with a 15
percent fee and a guaranteed maximum cost of $330,000 . 00 based on
an assumed scope of work. This form of contract was used because
the work had to be done immediately to limit the spread of
contamination and the scope of work was subject to change and
expansion during the project.

LAFAYETTE, CALIFORNIA
C. As the work progressed, the extent of contamination was found to
be greater than estimated, remediation measures required by the
Water Quality Control Board and the County Health Services
Department were more extensive than expected and impacts on
property owners caused more expense and .delay than anticipated.
Consequently, the actual scope and cost of work exceeded that
which was assumed under the original agreement, and a change
order is required to raise the original Guaranteed Maximum Cost.
