SPECIFIC REQUEST S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS 1. Hold a public hearing on the proposed ordinance to increase fees. 2. Adopt ordinance increasing in lieu fee to $2,000 per dwelling unit in West and Central Contra Costa County excluding the area delineated by the East County Planning Commission. FISCAL IMPACT Increased fees will enable the County to address park acquisition and development in a more timely manner. BACKGROUND/REASONS FOR RECOMMENDATIONS The County' s in lieu fee for park dedication has not be increased since 1978 except for East County and Alamo. The current fees do not reflect current land values or park development costs. On June 27 , 1989, the Board of Supervisors authorized the Community Development Department to have an appraiser to conduct a study on land values so that the park dedicated ' ordinance could be updated. That study is now complete (attachment);. The appraised values of land recently sold for residential develop- ment purposes is similar in West and Central County. The mean. for West County was $148 ,761 while the median was $157,250. In Central County the mean was $145 ,000 and the median . $161,000 . The mean in East County was 75,000 , which is the land value used in the recent ly adopted ordinance for East County. The formula for fee calculation, u- sing $145 , 000 an acre for land value and $85, 000 an acre for mini- mal development (turf and irrigation is $60 ,000 alone) , follows. Average Household Standard for Acres Park Land Per Size X Per 1,000 Population = Dwelling Unit Park Land Per Value of One Dwelling Unit X Acre of Park = In Lieu Fee The average household size for areas experiencing growth in Contra Costa County is 2 .90. This figure is determined by Census data. The standard required by State law is 3 acres per 1, 000 population or . 003 . If existing park land within the jurisdiction exceeds 3 acres, a higher standard can be used. Value of Park Land -- This is a local determination and therefore is the key discretionary item in the formula. The value of one acre of developed park (minimum development) is $230,000 in West and Central Contra Costa County. This is the sum of $145,000 per acre land cost and $85,000 per acre minimum development costs. The resulting calculations using the aforementioned formula are shown below: 2. 90 x . 003 = . 00870 acres of park per dwelling unit . 00870 x $230,000 = $2,000 as (rounded) as the in-lieu fee. Park Dedication fees in the County vary substantially by jurisdic tion. The range, depending on the type of development is from $-0- to $4,000 . The following survey shows present fees by jurisdic tion. Some jurisdictions use complex fee schedules involving appraisals and formulas while others have set fees by unit type. The fees shown below are for typical single family development; the most common development type in the county. County Board of Supervisors ordains as follows (omitting the parenthetical footnotes from the official text of the enacted or amended provisions of the County Ordinance Code) : SECTION I. SUMMARY. This ordinance amends the County Ordinance Code to increase the fee which may be paid in lieu of land dedication for park and recreational purposes for residential development in the entire County except the East County area. SECTION II. Section 920-6 . 204 of the County Ordinance Code is amended, to increase the general fee which may be paid in lieu of . land dedication, to read: 920-6.204. Amount of fee. Except as otherwise provided in this chapter for specifically described territory, when fees are to be paid in lieu of land dedication, such fees shall be two thousand dollars per dwelling unit. Article 920-6 .4 of the County Ordinance Code, added. by Ordinance No. 86-60 and specifying a different fee for the greater Alamo area, is repealed. SECTION IV. EFFECTIVE DATE. This ordinance becomes effective 60 days after passage, and within 15 days after passage shall be published once with the names of the Supervisors voting for and against it in the Contra Costa Times, a newspaper published in this County.
