February 27, 1990 County SUBJECT: LAND USE PERMIT #2138-86, BYRON GAS & MINI MART SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMM11ENDED ACTION: Direct the Community Development Department, the Health Services Department (Environmental Health Division) , and the County Administrator's Code Enforcement Coordinator to investigate allegations that conditions of approval for Land Use Permit #2138-86 have not been met with regard to the installation of a collect and convey system. BACKGROUND INFORMATION: It has been brought to my attention that the Byron Gas & Mini Mart, located at the southeast corner of the Byron Highway and Camino Diablo, has not met a condition of its land use permit to install a collect and convey system. This situation was also called to the attention of the Community Development Departmnt in a letter dated January 28, 1990, from Mike Roberts of Byron (copy attached) . Mr. Roberts indicates that he and his neighbors are concerned their yards and wells are being contaminated by gasoline, oil and anti-freeze by a ditch that carries rain water from the gas station through the neighboring properties . This could pose serious health concerns if this is, in fact, occurring. I have great concern if conditions the county has implemented is not being met or if the station is circumventing procedures .
