Amounts Dickman-Nourse, Inc. $3,378,000.00 which Payment: 120 Pioneer Way includes $3,338,000.00 $1,689,000.00 - Mountain View, CA 94039 Base Bid, $2,000,000 Performance: Additive Alternate $3,378,000.00 No. 1, $22,000.00 Additive Alternate No. 2, and $16,000.00 Additive Alternate No. 3 West Coast Contractors, Inc. Suisun, California Echo West, Inc. San Francisco, California Ralph Larsen and Son, Inc. Burlingame, California Arthur Bros. , Inc. San Mateo, California -Nibbi Bros. , Inc. San Francisco, California The above-captioned project and the specifications therefor having been previously approved, Addenda No. 1, No. 2 and No. 3 having been issued and approved, and bids having been duly invited and received by the Director of General Services; and The bidder listed first above ("Dickman-Nourse") having submitted the lowest monetary bid which is $30,200.00 less than the next lowest bid (base bid and 3 alternates) ; and Dickman-Nourse having submitted a bid which provides for minority business enterprise participation of 2.9% and women business enterprise participation of 5.1% of the base bid, as well as documentation of Dickman-Nourse's effort to meet the goals and requirements of the County's Minority and Women Business Enterprise Program; and The Board having heard and considered written and oral presentations from County staff; and The Board having evaluated all of the documentation of the effort by Dickman-Nourse to comply with the goals and requirements of the County's Minority and Women Business Enterprise Program; and Page 1 of 2 AWARD OF CONTRACT FOR 250-8741/B.4 CENTRAL COUNTY CORPORATION YARD February 27, 1990 FOR PUBLIC WORKS DEPARTMENT, IMHOFF PLACE AND IMHOFF DRIVE, MARTINEZ The Director of General Services and the Affirmative Action Officer recommending that the bid listed first above is the lowest responsive and responsible bid, and this Board concurring and so finding; NOW, THEREFORE, the Board finds, determines and orders as follows: -rhe Board DETERMINES that Dickman-Nourse, as the lowest monetary bidder, has made a good faith effort, pursuant to Public Contract Code Section 2000 and the specifications for this project, to comply with the goals and requirements of the County's Minority and Women Business Enterprise Program. The Board ORDERS that the contract for the furnishing of labor and materials for said work is awarded to said first listed bidder at the listed amount and at the prices submitted in said bid, and that said contractor shall present two good and sufficient surety bonds as indicated above; and that the General Services Department shall prepare the contract therefor; and the Board FURTHER ORDERS that after the contractor has signed the contract and returned it, together with the bonds as noted above and any required certificates of insurance or other required documents, and the Director of General Services has reviewed and found them to be sufficient, the Director of General Services is authorized to sign the contract for this board; and The Board FURTHER ORDERS that in accordance with the project specifications and/or upon signature of the contract by the Director of General Services, any bid bonds posted by the bidders are to be exonerated and any checks or cash submitted for security shall be returned; and The Board FURTHER ORDERS that the Director of General Services is authorized to sign any escrow agreements prepared for this project to permit the substitution of securities for moneys withheld by the County to ensure performance under the contract, pursuant to Section 22300 of the Public Contract Code; and The Board FURTHER ORDERS that the Director of General Services is authorized to consent to the substitution of another person as a subcontractor, in any of the situations listed and after the written notice specified in Public Contract Code Section 4107, provided written objections to such substitution are not submitted by the listed subcontractor in accordance with the Section 4107. The Board DECLARES that, should the award of the contract to Dickman-Nourse be invalidated for any reason, the Board would not in any event have awarded the contract to the second listed bidder or any other bidder, but instead would have exercised its discretion to reject all of the bids received. Nothing herein shall prevent the Board from reawarding the contract to another bidder in cases where a successful bidder establishes a mistake, refuses to sign the contract or fails to furnish required bonds or insurance (See Public Contract Code Sections 5100-5107) . 1 hereby certify that this is a true and correct copy of Orig.
