THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Resolution on February 27 , 1990 by the following
vote:

SUBJECT: Completion of Improvements, Declaring Certain Roads as
County Roads and approval of Road Improvement Agreement
for a Portion of Vintage Parkway for Subdivision 6862 ,
Oakley Area.
On January 5, 1988 , this Board approved a Road Improvement
Agreement for Subdivision 6862 with Hofmann Company, developer,
whereby said developer agreed to complete all improvements as
required in said Road Improvement Agreement. ' The Improvements
generally consists of approximately 3 , 400 linear feet of Vintage
Parkway and Stage I improvements to Highway 4 ; in . the Oakley
area.
The Public Works Director has notified this Board that the
Vintage Parkway improvements from the easterly boundary of
Subdivision 6821 to the overcrossing have been completed as
provided in said agreement.
In order to allow the release of a major portion of the Road
Improvement Agreement bond for the completed portion of Vintage
Parkway while the developer continues negotiation with adjacent
property owners, which prevents the completion of the portion of
Vintage Parkway from the overcrossing to Highway 4 , the
following documents were presented for Board Approval .
I.. A bond rider dated February 27 , 1990, issued
by The American Insurance Company, to modify
Bond No. SC6463565, issued December 17 ,
1987 , reducing the faithful performance and
maintenance bond from $389, 565 to $42 , 735 and
labor and materials from $196 , 750 to
$142 , 450.
II . A Road Improvement Agreement with Hofmann
Company, developer, whereby said developer
agrees to complete all improvements as
required in said Road Improvement Agreement
within one year from the date of said
agreement. The improvements generally
consists of completing Vintage Parkway from
the overcrossing to Highway 4 , including the
Stage I Highway 4 improvements.
Said document was accompanied by security to guarantee the
completion of road and drainage improvements as required by
Title 9 of the County Ordinance Code, as follows:
A. Cash deposit (Auditor' s Deposit Permit No.
168775, dated February 9 , 1990) in the amount
of $1, 000 made by Hofmann Company.
B. Additional security in the form of a
corporate surety bond dated January 26, 1990,
and issued by The American Insurance Company
(Bond No. 11132738920) with Hofmann Company
as principal, in the amount of $21, 538 for
faithful performance and $54 , 300 for labor
and materials.

NOW THEREFORE BE IT RESOLVED that the Vintage Parkway
improvements from the easterly boundary of Subdivision 6821 to
the overcrossing have been COMPLETED as of February 27 , 1990
thereby establishing the six-month terminal period for the filing
of liens in case of action under the Road Improvement Agreement:

BE IT FURTHER RESOLVED that the hereinafter described road,
as shown and dedicated for public use on the Final map of
Subdivision 7089 filed August 9 , 1988 , in Book 324 of Maps at
page 12 , Official Records of Contra Costa County, State of
California, is ACCEPTED and DECLARED to be a County Road.

BE IT FURTHER RESOLVED that the beginning of the one year
warranty period is hereby established, and the $3 , 935 cash
deposit (Auditor' s Deposit Permit No. 133708 , dated December 18 ,
1987) made by Hofmann Company be RETAINED for one year pursuant
to the requirements of Section 94-4 . 406 of the Ordinance Code.
BE IT FURTHER RESOLVED that the Road Improvement Agreement
approved by the Board on January 5, 1988 , is hereby AMENDED to
allow reduction of the performance and maintenance bond to
$42 , 735 in accordance with Section 94-4 . 406 of the Ordinance
Code, and labor and material bond to $142 , 450 .
BE IT FURTHER RESOLVED the Road Improvement Agreement for
Vintage Parkway from the overcrossing to Highway 4 is APPROVED.
I hereby certify that this Is a true and correct copy of
an action taken ana entered on the minutes of the
Board of Supervisors on the date shown.
