Contra FROM: Costa Phil Batchelor, County Administrator County DATE: February 16, 1990 rA coux�"` SUBJECT: LEGISLATION: SB 1894 (Ayala) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECONDIENfDATION: Adopt a position in SUPPORT of SB 1894 by Senator Ayala which would increase ; the penalties for possession of specified combinations of 'chemicals at the same time with the intent to manufacture specified controlled substances. BACKGROUND: Under current law, it is a felony, punishable by imprisonment in the state prison. for 3, 4, or 5 years for any person to possess specified combinations of chemicals at the same time with the intent to manufacture specified controlled substances or specified analogs of those substances. Senator Ayala .has introduced SB 1894 which would increase these penalties to 5, 7, or 9 years in the state prison. Since SB 1894 increases the penalties for violating the laws relating to the manufacture of illlegal drugs it appears to be consistent with the Board of Supervisors' war on drugs. It is, therefore, recommended that the Board indicate its support of SB 1894.
