MICHAEL WALFORD, CHIEF ENGINEER DATE: February 27, 1990 SUBJECT: Upper Pine Creek, Concord Area Project No.: 7520-668688 Task: ACO Account: 3540 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I. Recommended Action: A. APPROVE Amendment to Right of Way Contract dated January 25, 1990, from Emile Olivieri, et al. B. AUTHORIZE Chief Engineer to execute said Amendment to Right of Way Contract on behalf of the District. C. AUTHORIZE the Auditor-Controller to issue a check for $460 payable to Emile Olivieri, Lena Olivieri, Loretta Gardner, and Christine Banducci, to be forwarded to the Real Property Division for delivery. II. Financial Impact: Payment of $460 from Flood Control Zone 313 funds which are 75% reimbursable from State Department of Water Resources. III. Reasons for Recommendations and Background: To reimburse property owners for one additional year's water expenses resulting from Upper Pine Creek project's disruption of canal water supply. IV. Consequences of Negative Action: Failure to compensate could result in litigation.
