SUBJECT: Zoning issues
The Board received the attached letter dated February 4,'
1990 from Mr. and Mrs. Daniel J. Spillane, 1075 Marie Avenue,
Martinez 94553 , relative to concerns about livestock on residential
property.
Mr. Spillane appeared before the Board this date and
requested the Board' s assistance to resolve the problem.
IT IS BY THE BOARD ORDERED that the County Administrator
is REQUESTED to coordinate a meeting with Mr. Spillane, the
Community Development Director and Zoning Administrator relative to
a proposed ordinance which would limit size and number of livestock
allowed on residential lots and establish buffer zones between
residential and agricultural properties.
IT IS FURTHER ORDERED that the matter is REFERRED to the
Health Services Director for review.

To the County Board of Supervisors,
Please rote that attaches; is a ccpy of the original letter my wife
and I sent to Supervisor Fanden bac' in March of 1989. The horse problem
is still witn us. We have been informed that this is going to be a
permanent situation.
The property is zones' A-2 Agricultural that abuts up to the city
property line where our resicence is located. There are tx;7o full groi-n-
horses that are within 20 feet of my home.
I 'have contactee. the County Zoning Department, and they have states to us
that thesis nothing in the zoning ordinance concerning the number of
livestoc'c, the lot size or the number of feet horses must Y-- from an
adjoining residence, for A-2 Agricultural zoning.
We are proposing to get this matter put on the agenda for t'ne
Boars of Supervisors 'to consider a oreinance change, or some sort of
guidelines concerning this type of situation.
We -would like to have a. consideration., (1) . Lot size. (2) . A limit
to the number of livestock allowed. (3) . A buffer zone of at least
250 linear feet from an ajoining residence.
We would appreciate getting the A-2 Agricultural County Zoning
specifications a little bit clearer for all concerned. We would like
to appear ",--fore the Board of Supervisors to dicuss our concern in this
matter.

Supervisor Fanden,
My wife and I purchased a home in Contra Costa County some twelve years
ago. The property is divided into two parcels. Parcel one the prime residence
lies in the city limits of Martinez. Parcel two lies in the jurisdiction of
Contra Costa County. We receive two different property tax statements.
There are nine residences on Marie Ave. that are similar to ours in the
division of their properties.
The proplem is that my neighbor who lives at 1067 Marie Ave. has just
moved two horses into the back portion of her property,which is county and
where the problem originates. The area that she has placed these horses in is
aprox. 60 feet long by 30 wide. Can two horses be placed in such a small area?
The two horses are within 20 feet of my home. The oder from the horses being
so close to my home is overwhelming. The oder of the horse urine is just
plain terrible. The smell is bad noir, and will only become worse as the
urine ferments in the hot Contra Costa summ°r months. I cannot open the
windows to my home, because the smell would permeate through my entire
house as Bre live down wind from the horses. The flies are also evident now
in these cool months. The flies i7ill only get worse as the hot weather is
conducive to the growth of the fly larva. The condition is unhealthy and
unsanitary. My three children refuse to play out side in my back yard because
the oder from the horses is so bad. The flies are bothersome to them also.
I have tried to dicuss this problem first with my neighbor by asking
her to remove the horses. She flatly refuses. She stated to me, " If push
comes to shove the horses will stay exactly where they are".
I have contacted both the Zoning office and the Health Department in
the county but to no avail. I have also contacted the city of Martinez
Zoning and Planning commission. The city stated that the problem originates in
the county and that it wasn't in their scope of power.
We did find out from the city of Martinez that they have an ordinance
restricting horses to an area of no less than one half acre per horse. The
horses must also be restricted by one hundred feet from an adjoining residence.
Supervisor Fanden, it's not that my wife and I don't like horses we do,
but a horse brings flies and two horses bring twice as many. The oder from
one horse is bad, but the oder from two horses in such a small area is terrible.
The ground becomes contamined with this obnoxious oder.
As our Supervisor, we have no one eles to turn to. My wife and I would
appreciate any help and advice that you can give us in this matter so that
it can be resolved as soon as possible.
