BACKGROUND: Each month the County' s Construction Manager for the West County Justice Center, Marsh Creek Detention Center and Martinez Detention Facility, O'Brien-Kreitzberg & Associates, Inc. files a progress report with the County on the work they are supervising on the construction of the West County Justice Center, Marsh Creek Detention Center and the Main Detention Facility in Martinez. Progress Report # 17 for December, 1989 notes, in regard to the West County Justice Center that the Contractor' s progress has slipped the last month. Instead of being ahead of schedule, the Contractor is now only on schedule. This delay is due to a lack of manpower for electronics, painting,HVAC, and plumbing which is delaying follow-on trades. The Contractor has signed a new sub-contract for electronics and is to obtain a new painting subcontractor. The report also notes that Changes and Potential Changes will exhaust the available contingency, leaving a deficit of $87,570. The program contingency of approximately $600,000 will be transferred to cover future changes and the projected deficit. INTRODUCTION: This report is subdivided into three major sections: 1) Executive Brief and Summary, 2) Detailed Schedule and Financial Information and 3) Attachments. The revised draft is scheduled for final County review in mid-January before the Draft EIR is issued for public review and comment. b. WCJC Advisory Group The Advisory Group's quarterly meeting was held on December 6 in San Pablo. CONTRA COSTA COUNTY - X'U'STICE PROGRAM PROGRESS REPORT NO. 17 DECEMBER 198-9 E. MAJOR AREAS OF CONCERN: 1. West County Justice Center: + Contract B: Walsh Construction Company a. Light Fixtures, Building 4: Issue: There is not enough room between the ceiling and diffuser above the lavatories in Building 4 cells for the light fixtures. Action: The Construction Manager has directed the Architect to explore several alternate solutions to reduce cost. b. Water Repellant Coatings: Issue: The specified water repellant coating being used did not perform as specified. Action: The Contractor was directed to stop further applications, and tests were performed on the substitute material as well as the specified materials. The substitute material failed all tests. The Contractor was directed to use the specified water repellant. C. Return Air Ducts: Issue: The State Fire Marshal has stated that plenum air returns will not be allowed over required exits. Action: The Construction Manager directed the AE to explore several solutions including adding return air ducts, rerouting the return air around the corridors, installing rated ceilings or some combination of these. d. Food Cart Changes: Issue: The food services consultant has not developed criteria to specify and evaluate revised cart designs by various manufacturers. Action: The Construction Manager directed the Architect to prepare criteria and guidelines for evaluation for change order pricing. e. Fencing: Issue: The non-climbable fabric on the exterior fence has been questioned by the Sheriff's Department who requested a field test. Park Drainage: Issue: Rain drainage flows across the adjacent park property. During the first major storm, run-off silt from the project washed across the park access road. Action: The Construction Manager directed the Architect to re-evaluate the drainage design and directed the Contractor to clean the road. g. Seamless Floor Claim: Issue: The Contractor has presented his claim for alleged ,defective specifications. Action: The Construction Manager has submitted a recommendation to the County for a final decision. h. Arcade Column Claim: Issue: The Contractor has presented his claim for alleged defective drawings. Action: The Construction Manager is to submit a recommendation to the County for a final decision. i. Impact Claim: Issue: The Contractor has made the allegation that his mechanical subcontractor, McClenahan, cannot fully evaluate the schedule effect of change orders until all of the change orders are evaluated in total at the end of the project. Action: The Construction Manager has denied this allegation because the contract documents are clear that each change order must be evaluated separately and that general impact is not allowed. j. County Code Change Claim: Issue: The Contractor has made the allegation that the interpretation of fire separations made by the County Building Inspection Department has cost them time and money. Multiplicity Claim: Issue: The Contractor has alleged that he has lost time and money because of the quantity of changes; therefore, he intends to file a claim at the end of the project for additional compensation. Action: The Construction Manager has denied the allegation because the contract documents state that the Contractor should be prepared for as many; as 1,000 RFIs plus up to 57 in change orders. The impact of each change will have to stand on its own. 1. Schedule: Issue: The Contractor's progress has slipped the last month. In lieu of being ahead of schedule, they are now on schedule. Action: The Contractor: 's delays are due to a lack of manpower for electronics, painting, HVAC and plumbing which is delaying follow-on trades. SCHEDULE ANALYSIS 1. GENERAL: The detailed schedule report is subdivided by three projects: 1) West County Justice Center, 2) Marsh Creek Detention Facility and 3) Martinez Detention Facility. The three projects are further divided into the design and construction phases. The design portion will include general design data and a progress narrative. The construction section will be subdivided by each contract and will provide contract data, a progress narrative, plus a bar chart. 2. West County Justice Center a. Design: The status for ongoing design phase is: Equipment - Complete. Signage - Complete; being prepared for bidding Furniture - Complete; the P.M. , Transition Team and Purchasing Department need to identify the method of furniture and equipment procurement and begin the process. b. Construction: The West County Justice Center project includes two contracts: 1) The first contract was for the rough grading of the project site (Contract A), which is substantially complete. 2) The second contract is for the construction of the detention facility (Contract B). PROGRESS NARRATIVE The rate of construction slowed during December. The major delay was preparing areas within Building #1 for the communication equipment. Because those areas of the building were not completed, the communication equipment was not delivered, and installation did not begin. PROGRESS BAR CHART: A progress bar chart is included to this report (Attachment D). It compares the actual physical progress of field activities to their scheduled progress. Design The Board of Corrections/State Fire Marshal design review comments were received on November 27 and forwarded to the Architect for incorporation into the contract documents. These final corrections are under way. Because of current interpretation of the fire separation requirements, the final corrections are taking longer than initially scheduled. A meeting with the County's project team will be scheduled for January 8 and the corrected drawings will then be returned to the State Fire Marshal for final review and stamping. SECTION II/PART B FINANCIAL ANALYSIS 1. General: The detailed financial report is divided into three projects: 1) West County Justice Center, 2) Marsh Creek Detention Facility and 3) Martinez Detention Facility. The projects are further divided into the Design and Construction phases. The Design portion will include a narrative. The Construction section will be subdivided by each contract and will provide contract data, where available, narratives and cost curves. 2. West County Justice Center a. Design: The Architect's basic fee is $2,494,423 of which $2,344,380 (949) has been paid. In addition, the Architect has been authorized $608,276 for extra services, of which $540,338 (899) has been paid. b. Construction: The West County Justice Center financial report includes two contracts: 1) The first contract was for the rough grading of the project site (Contract "A") which is substantially complete. The remaining contingency for Contract "A" is $3,743. 2) The second contract is for the construction of the detention facility (Contract "B"). The remaining contingency for Contract "B" is $(87,570). Claims which have been priced are $333,057. In addition, the Contractor has requested claims in the amount of $42,946 which have been denied. The program contingency has approximately $600,000, which will be transferred to cover future changes and the projected Contract B deficit.
