SUBJECT: Regional Transportation Mitigation Fund Agreement -
Pleasant Hill BART Station Area
SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION.
RECOMMENDATIONS
Approve and authorize the Chair to execute a Regional Transpor-
tation Mitigation Fund Agreement with Oak Court Partners, a General
Partnership, (Pleasant Hill BART Station Area) .
FISCAL IMPACT
This Regional Transportation Mitigation Fund Agreement permits Oak
Court Partners to defer payment of a Regional Transportation
Mitigation Fee that has been imposed upon them as a condition of
approval for their Development Plan. The Regional Transportation
Mitigation Fund Agreement provides that the payment of the fee at a
later date be secured during the deferment period by a irrevocable
stand by Letter of Credit.
BACKGROUND/REASONS FOR RECOMMENDATIONS
Condition number 9 for Final Development Plan 3059-87 (Taylor
Woodrow/Oak Court : Office Building) in the Pleasant Hill BART
Station Area requires that the developer further mitigate traffic
impacts by participating equitably in a Regional Transportation
Mitigation Fund either by consenting to and assisting with the
creation of, and participation in a Parking Fee Assessment District
or by paying a one-time fee of 50 cents per gross square foot of
office building. It is the preference of the County to retain the
option of establishing a Parking Fee Assessment District.
Therefore, it is in the County' s interest to not collect the 50
cents per gross square foot fee at this time. Should the County be
unsuccesful in establishing a Parking Fee Assessment District it_. .
will need a mechanism to collect the 50 cent fee at a future time.

The Regional Transportation Mitigation Fund Agreement is the
mechanism for guaranteeing that said fee can be paid to the County
at a future time as ;specified in the agreement.
The Regional Transportation Mitigation Fund Agreement generally
provides for the following:
1. In lieu of paying the 50 cents per gross square foot fee
at the time of issuance of building permit the developer
is permitted to provide the County with an irrevocable
Letter of Credit securing the payment of the required fee
in the future.
2. Permits the developer to consent to the participation in
a Parking Assessment District in lieu of paying of
required free; and
3 . Provides the County with an approximate two year window
in which ; to form and structure a Parking Assessment
District.
