SUBJECT: Hearing to consider a General Plan Amendment, Williamson
Act cancellation, Minor Subdivision, rezoning and land
use permit for the Keller Canyon (Keller-Bailey)
Landfill in Contra Costa County.
This is the time heretofore noticed for hearing on the requests
by Keller Canyon Landfill Company (applicant) and Kathryn Costa,
Charles Larson, Herbert Elworthy, Jean Elworthy and Robert Elworthy
(owners) to amend the General Plan (GPA 3-89-Co.II ) , for approval of
Minor Subdivision 15-89, Rezoning Application 2834-RZ, Williamson Act
cancellation (AG 6-71, Part 8-69) , and Land Use Permit 2020-89 to
establish a sanitary landfill facility on a 2, 628 acre site located in
Contra Costa County.
The following people appeared to speak on behalf of the
applicant:
Tom Bruen, representing the applicant , Keller Canyon Landfill
Company, spoke in favor of the request before the Board and presented
requested modifications to be included in a new General Plan Amendment
for the Keller site. '
Jill Shapiro, Ph.D. , Project Director, representing Keller Canyon
Landfill Company, the applicant, presented the proposed landfill
project, including the methods of construction and operation.
The following persons appeared in opposition:

Dr. Jill Shapiro spoke in rebuttal.
Supervisor McPeak questioned Dr. Shapiro on the issue of the
revegetation time frame on the cut slopes.
Dr. Shapiro responded to Supervisor McPeak' s question.
Supervisor Fanden commented on the condition of approval relative
to the deeding of development rights on the landfill site to insure
the use of the landfill after closure being in the public interest,
and for open space only.
Mr. Bruen responded to Supervisor Fanden' s concern.
Supervisor Torlakson requested clarification on the visibility of
the landfill site from Concord and neighborhoods on the Concord side
of the ridge, and on peak height increase.
Dr. Shapiro responded that the landfill would not be visible in
any way from Concord.
Supervisor Torlakson questioned the amount of the capital costs
in setting up the landfill site, and whether the costs included any
value compensation to homes and businesses in the area.
Dr. Shapiro responded that the applicant would provide that
information.
Supervisor Torlakson questioned the applicant' s mitigation in the
proposed Bailey Road interchange.
Dr. Shapiro responded to Supervisor Torlakson' s question.
Supervisor Powers requested verification of the cost of the
landfill as presented in the EIR.
Dr. Shapiro responded to Supervisor Powers ' question.
Supervisor Torlakson requested from County Counsel and the
applicant the justification for the cancellation of the Williamson Act
Contract.
Mr. Bruen responded to Supervisor Torlakson' s request.
Victor Westman, County Counsel, clarified the point of closing
the hearing for oral testimony and leaving the record open for written
testimony.
Supervisor Powers moved to close the oral public testimony and to
leave the written testimony open until 5: 00 p.m. on February 20, 1990.
IT IS BY THE BOARD ORDERED that the hearing on the General Plan
Amendment, Williamson Act cancellation, minor subdivision, rezoning,
and land use permit for the Keller Canyon (Keller-Bailey) Landfill is
CLOSED for oral testimony, with the record left open for written
comment until February 20, 1990 at 5 :00 p.m. ; and the matter is
DEFERRED for decision to February 27, 1990 at 2 : 00 p.m.
