Reports for the Keller Canyon Landfill and the
Marsh Canyon Sanitary Landfill Projects
SPECIFIC REQUEST(S) OR RECIOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION
Certify that the Board of Supervisors has reviewed the Final
Environmental Impact Reports (FEIRs) for the Keller Canyon Land-
fill project and the Marsh Canyon Sanitary Landfill project, and
finds that each is adequate and that each has been prepared in
accordance with the California Environmental Quality Act, as
amended (CEQA) , as recommended by the County' s Zoning Adminis-
trator.
REASONS FOR RECOMMENDATION/BACKGROUND
Approvals of the planning applications sought by the sponsors of
the Keller Canyon Landfill and the Marsh Canyon Sanitary Landfill
projects, items T. 6 and T.7 on the Board of Supervisors ' agenda
for February 13 , 1990, are discretionary actions which would have
significant and potentially significant adverse impacts on the
environment if carried out. Consequently, the projects, and
decisions on them, are subject to the California Environmental
Quality Act, as amended. The Board must certify that each FEIR
is adequate and that it was prepared in accordance with CEQA
before it can act on the project' s respective actions.
The County' s Zoning Administrator has submitted two resolutions,
dated February 7, 1990, recommending that the Board find each
Final Environmental Impact Report to be adequate. The resolu-
tions provide a chronology of how the FEIRs were processed to
comply with CEQA, and identify the documents that comprise the
FEIR (the October, 1989, Draft EIR, in two volumes, and the Final
Environmental Impact Report response document) .
Before approving a project' s applications, the Board must affirm
that it has considered the project' s FEIR and, in the course of
acting on the project, the Board must make findings on the FEIR' s
impacts and mitigation measures, and make ' a Statement of Over-
riding Considerations for adverse impacts which cannot be
mitigated to insignificant levels.

This being the time heretofore noticed for hearing on the above matter, the
public hearing was opened. Fred Caploe, representing the City of Pittsburg,
commented on the submission of written opposition. The public hearing was
closed. IT IS BY THE BOARD ORDERED that the staff recommendation is
APPROVED.
