Acknowledge receipt of Progress Report # 16 from
O'Brien-Kreitzberg & Associates, Inc. on work on the County' s
detention facilities for the month of November, 1989 .
BACKGROUND:
Each month the County' s Construction Manager for the West County
Justice Center and Martinez Detention Facility,
O'Brien-Kreitzberg & Associates, Inc. files a progress report
with the County on the work they are supervising on the
construction of the West County Justice Center and the Main
Detention Facility in Martinez. Progress Report # 16 for
November, 1989 notes, in regard .to the West County Justice Center
that the Contractor' s progress has slipped the last two months.
In lieu of being ahead of schedule, the Contractor is now on the
brink of falling behind schedule. This delay is due to a lack of
manpower for electronics, HVAC and plumbing which is delaying
follow-on trades. The Contractor has signed a new sub-contract
for electronics and more personnel have been brought on board.
The report also notes that Changes and Potential Changes equal
97% of the $1. 58 million contingency, leaving a balance of
$34,800 .
In regard to the Main Detention Facility in Martinez, the
Progress Report notes that comments on the 90% complete contract
documents were received from the Department of Correction on
November 20, 1989 . The architect is now able to complete the
contract documents for bidding. These final corrections will be

made in December. A meeting with the County' s project team will
be scheduled in January and the corrected drawings will then be
returned to the State Fire Marshal for final review. These
documents should be issued for bidding in late January or
February, 1990. The Project Manager still estimates that the
project is currently -projected to be over budget by $290 ,000 .
In regard to the Marsh Creek Detention Facility, the Progress
Report notes that miscellaneous "punch list" and warranty work is
ongoing. Work by different subcontractors is being done
concurrent with work on the additional classrooms currently being
installed at Marsh Creek by the same contractor. The financial
analysis shows a remaining budget of $1. 3 million.

EXECUTIVE SUMMARY
A. INTRODUCTION:
This report is subdivided into three major sections: 1) Executive Brief .and
Summary, 2) Detailed Schedule and Financial Information and 3) Attachments.
It describes the design and construction progress for the West County
Justice Center, Marsh Creek Detention Facility and Martinez Detention
Facility achieved during the period of November 1989 as well as Areas of
Concern.
B. GENERAL:
1. West County Justice Center
a. Revised Environmental Impact Report
The County's comments to the administrative draft of the EIR will be
sent to the consultant in early December.
b. WCJC Advisory Group
The Advisory Group's next quarterly meeting is December 6.

The 100% complete furniture contract documents were received on
November 17.

907 complete contract documents on November 20. The Architect is
now able to complete the contract documents for bidding.

E. MAJOR AREAS OF CONCERN:
1. West County Justice Center:
Contract B: Walsh Construction Company
a. Ground Conductors:
Issue: The ground system designed for the project includes an
elaborate dual, ground fault interceptor system that surpasses
the performance of grounding wires. The ground fault system is
not yet incorporated into the national electric code. Therefore,
the grounding conductors for four of the ten main panels are not
the proper size. The Construction Manager asked the County
Building Inspection Department to consider the existing sized
grounding conductors in light of the ground fault interceptor
system but this request was denied and the Department requires
the, grounding conductors be sized in accordance with the code.
Action: The Construction Manager has directed the contractor to
replace three of the conductors and to r6-size the circuit
breaker on the fourth, so that they will comply with the County
code inspector's interpretation.
b. Water Repellant Coatings:
Issue: The specified water repellant is not performing as
expected. During the performance spray test, water is
penetrating thru to the inside face of the block.
Action: The Construction Manager has directed the. contractor to
stop ' the application of water repellant. The CM has obtained a
consultant and testing firm to determine if this material is
performing as expected and if this is the proper material for the
project. The Construction Manager has also contacted three other
water repellant suppliers and is testing their products on this
project to determine the best product.
C. Gas Piping:
Issue: The County Building Inspection Department directed the
contractor to use galvanized iron pipe in lieu of black iron pipe
in exterior locations as specified. The Construction Manager
estimated this change would cost approximately $35,000.
Action: The Construction Manager has researched the codes and
the prevailing practice concerning exposed gas lines and finds
that the code allows either black iron or galvanized pipe.
Therefore, the County Code Department was requested to reconsider
their direction to avoid the change.

Contract B: Walsh Construction Company(Cont'd)
d. Fencing:
Issue: The Contractor has objected to the use of the specified
11 gauge hog rings as a fastening device for attaching the hard
cloth to the tie wires on the outer fence. The Contractor claims
it is impossible to use the 11 gauge hog rings because they tear
up the 22 gauge hard cloth.
Action: The Construction Manager has directed the Architect to
research other fences with the hard cloth to determine if 9 gauge
hog rings are used to fasten them.
e. Temporary Heat:
Issue: Many of the finish items will be installed during the
winter and are susceptible to damage under cold, damp conditions.
The Contractor stated that he intends to use the permanent
building heating system to furnish temporary heat to protect
these items.
Action: -The Construction Manager will research the plans and
specifications to determine if use of heat is allowed.
f. Seamless Floor Claim:
Issue: The Contractor has issued his claim requesting a final
decision by the County.
Action: The Construction Manager will schedule a meeting with
the County to hear the contractor's claim.
g. McClenahan's Reservation:
Issue: The Contractor has made the allegation that his
mechanical subcontractor, McClenahan, cannot fully evaluate the
schedule effect on change orders until all of the change orders
are evaluated in total.
Action: The Construction Manager has denied this allegation
because the contract documents are very clear that each and every
change order must be evaluated separately.
h. Arcade Column Claim:
Issue: The Contractor has issued his claim requesting a final
decision by the County.
Action: The Construction Manager will schedule a meeting with
the County to hear the contractor's claim.

i. County Code Changes: .
Issue: The Contractor has alleged that the interpretation of
building fire separation made by the County Building Inspection
Department has cost him time and money.
Action: The Construction Manager denied the claim because the
contractor failed to provide a schedule analysis. However, the
Construction Manager also expects the contractor to return this
claim with his backup documentation and the Construction Manager
is preparing a response.
j. Multiplicity Claim:
Issue: The Contractor has alleged that he has lost time and
money because of the quantity of changes; therefore, he intends
to file a claim at the end of the project for additional
compensation.
Action: The Construction Manager has denied the allegation
because the contract documents state that the Contractor should
be prepared for as many as 1,000 RFIs plus a 5% change order
allowance. The impact of each change will have to stand on its
own.
k. Security Fence Fabric:
Issue: The Sheriff has requested a meeting with the Security
Consultant since they are concerned with the specified
non-climbable fabric.
Action: A meeting was held on October 5. The Security Consultant
is to provide requirements to test the fence system.

Issue: The Contractor's progress has slipped the last two

SCHEDULE ANALYSIS
1. GENERAL:
The detailed schedule report is subdivided by three projects: 1) West
County Justice Center, 2) Marsh Creek Detention Facility and 3) Martinez
Detention Facility. The three projects are further divided into the design
and construction phases. The design portion will include general design
data and a progress narrative. The construction section will be subdivided
by each contract and will provide contract data, a progress narrative, plus
a bar chart.
2. West County Justice Center
a. Design:
The status for ongoing design phase is:
Equipment - Complete.
Signage - Complete.
Furniture - Complete, the P.M. , Transition Team and purchasing
need ,to review the method of furniture and equipment
procurement and begin the process.
b. Construction:
The West County Justice Center project includes two contracts:
1) The first contract was for the rough grading of the project site
(Contract A), which is substantially complete.
2) The second is for the construction of the detention facility
(Contract B).

Once the 10 day time extension is approved, the contractor will be on

2. PROGRESS NARRATIVE
The rate of construction slowed during November. The major delay was
preparing areas within Building #1 for the communication and kitchen
equipment. Because those areas of the building were not completed, the
communication and kitchen equipment was not delivered and installation did
not begin.

2. PROGRESS NARRATIVE (Cont'd)
a. Building One (Administration Building): The work is behind schedule.
The current critical activities are partition walls, and the
installation of kitchen and communication equipment. A separate sheet
rock taping crew has been employed for this building to help and the
contractor has been directed to complete specific areas in order to
start other activities.
b. Building Two (Medical/Dental/Library/Classroom Building): The work is
on schedule. The current critical activity is partition walls, which
is progressing as scheduled.
C. Building Three (Multi-purpose Building): The work is on schedule,
although it shows signs of slipping. The current critical activity is
duct work which is significantly behind schedule.. The metal studs and
door frames have been installed out of sequence and ahead of schedule.
The contractor has been directed to start partition walls even before
the ductwork is finished to prevent delays.
d. Building Four (Intake Housing/Central Visiting): The work has fallen
behind schedule. The structocore system for the walls of security
cells have proven much more complicated and difficult than anyone
expected. Also, a multitude of details have been issued by the
Architect that were not shown in the original contract documents. The
current concern is the drying time of the plaster, which is
susceptible to weather conditions and may be the controlling factor
for completion.
e. Building Five (Inmate Housing): Ahead of schedule. The current
critical activity is communication wiring and terminations.
f. Building Six (Inmate Housing): Ahead of schedule. The current
critical activity is communication wiring and terminations.
g. Building Seven (Inmate Housing): Ahead of schedule. The current
critical activity is communication wiring and terminations.
h. Building Eight (Inmate Housing): On schedule. The current critical
activity is communication wiring and terminations.
3. PROGRESS BAR CHART:
A progress bar chart is included to this report (Attachment D). It
compares the actual physical progress of field activities to their
scheduled progress. As of the end of November, construction is about 78.3%
complete compared with the scheduled completion of 79.5%.

4. Martinez Detention Facility
a. Design
The Board of Corrections/State Fire Marshal design review comments were
received on November 27 and forwarded to the Architect for incorporation
into the contract documents. These final corrections will be made in
December. A meeting with the County's project team will be scheduled in
January and the corrected drawings will then be returned to the State Fire
Marshal for final review and stamping. These documents should be issued for
bidding in late January or February.

FINANCIAL ANALYSIS
1. General:
The detailed financial report is divided into three projects: 1) West
County Justice Center, 2) Marsh Creek Detention Facility and 3) Martinez
Detention Facility. The projects are further divided into the Design and
Construction phases. The Design portion will include a narrative. The
Construction section will be subdivided by each contract and will provide
contract data, where available, narratives and cost curves.
2. West County Justice Center
a. Design:
The Architect's basic fee is $2,494,423 of which $2,344,380 (947.) has
been paid. In addition, the Architect has been authorized $608,276 for
extra services, of which $539,256 (89%) has been paid.
b. Construction:
The West County Justice Center financial report includes two contracts:
1) The first contract was for the rough grading of the project site
(Contract "A") which is substantially complete.
The remaining contingency for Contract "A" is $3,892.
2) The second contract is for the construction of the detention
facility (Contract "B").
The remaining contingency for Contract "B" is $34,411.

Contractor's forecasts (early start forecast and late start forecast) are

12/23/88 revised baseline schedule. The actual value of base contract work
completed to date is $21,423,879; for change orders, it is $369,587. The
total value to date becomes $21,793,466. The actual amount of payment to
the Contractor is the actual value of work less retention placed in an

The Marsh Creek Detention Facility financial report consists of the project
to design, fabricate and install two 120-bed modular dormitories. The
contract award was $2,571,450 of which $122,450 is a supplemental work

The project to upgrade the wastewater system is complete and has been
