SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION: Approve settlement in Outman v. Board of Supervisors, et al. , Superior Court No. C 89-03575, and authorize the Chairperson or the County Counsel to execute the settlement agreement on behalf of the County. FINANCIAL IMPACT: None. The settlement agreement provides that all parties will pay for their own costs and attorney' s fees . BACKGROUND: This suit challenged the Board's October 1, 1989 approval of Subdivision 7099, a six lot subdivision in the Alamo area. As part of the project, Thayer & Holt, the developer, had agreed to perform substantial drainage improvements in the Miranda Creek area. The settlement primarily involves Thayer and Holt agreeing to 1) height restrictions on two houses, 2) additional landscaping requirements, and 3) paying $6,000 to the petitioners. The settlement does not involve any other changes to the conditions of approval imposed by the Board. This office recommends approval of the settlement agreement.
