ABSTAIN: None
SUBJECT: Completion of Warranty Period and Release of Cash
Deposit under the Drainage Improvement Agreement for
Subdivision 6797, Alamo Area. APN# 192-280-003 & 007.
On February 7, 1989, this Board resolved that the off
site storm drain improvements for Subdivision 6797 were
completed as provided in the Drainage Improvement Agreement with
Thayer and Holt, Incorporated, and now on the recommendation of
the Public Works Director;
The Board hereby FINDS that the improvements have
satisfactorily met the guaranteed performance standards for one
year after completion and acceptance; and
IT IS BY THE BOARD ORDERED that the Public Works
Director is AUTHORIZED to refund the $1, 000 cash deposit
(Auditor's Deposit Permit No. 130713, dated October 7, 1987) plus
interest in accordance with Government Code Section 53079, if
appropriate, to Thayer and Holt, Incorporated, pursuant to the
Drainage Improvement Agreement and Ordinance Code
Section 94-4.406.
