' Costa n: �S County DATE: c�srq-coiiK`� cPv December 4, 1990 SUBJECT: ORDINANCE TO AUTHORIZE CITY OF BRENTWOOD TO PLAN THE REDEVELOPMENT OF CERTAIN UNINCORPORATED AREAS SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATIONS: 1) Waive second reading and adopt the Ordinance authorizing ,the City of Brentwood to plan the redbvelopment of certain unincorporated areas. 2) Authorize the Chair of the Board to send a letter to the City of Brentwood describing an agreement on the parameters for a future financial agreement. BACKGROUND: Over the last year, the county and city staffs have discussed a city proposal to annex and redevelop land in North Brentwood. This ordinance would authorize the city to proceed with redevelopment planning. However, ultimate authorization for the city and the Brentwood Redevelopment Agency to redevelop the property requires Board of Supervisors approval of the final redevelopment plan - expected to be submitted next summer. The Administrator is recommending the Board adopt the ordinance since the plan will benefit the citizens in the area and the county. Also, the Administrator is recommending that the attached letter be sent to the City of Brentwood which describes an agreement on the parameters of a future financial agreement in the territory to be annexed and redeveloped. CC: Community Development ATTESTED December 4, 1990 County Counsel PHIL BATCHELOR,CLERK OF THE BOARD OF Auditor's Office SUPERVISO AND COUNTY AD INISTRATOR BY ,DEPUTY M382 (10/88) Y ORDINANCE NO. 90-121 AN ORDINANCE AUTHORIZING THE CITY OF BRENTWOOD AND THE BRENTWOOD REDEVELOPMENT AGENCY TO REDEVELOP CERTAIN PORTIONS OF THE COUNTY OF CONTRA COSTA SUBJECT TO FURTHER APPROVAL The Board of Supervisors of the County of Contra Costa (the "Board" ) does ordain that: Certain unincorporated area of the County of Contra Costa, as shown on Exhibit A attached hereto and by this reference incorporated herein (the "County Area" ) , is in need of redevelopment and no redevelopment plan has yet been adopted for , said area; and The County Area is contiguous to portions of the City of Brentwood (the "City Area" ) that are being considered for redevelopment by the City of Brentwood (the "City" and the Brentwood Redevelopment Agency (the "Agency" ) ; and The County, the City and the Agency desire to cause the coordinated redevelopment of the County Area and the City Area as a unified redevelopment project; and Health and Safety Code Section 33213 permits the Board to authorize the redevelopment of the County Area by the City and the Agency. It is desirable, appropriate, and in the best interest of the residents of Contra Costa County and the residents of the City of Brentwood that this Board authorize the City and the Agency to redevelop the County Area or any appropriate portion thereof, commencing with the preparation of a redevelopment plan (the "Redevelopment Plan" ) for the County Area and the 'City Area (or appropriate portions thereof) ; it being understood by such authorization that the Redevelopment Plan for such area must be subsequently approved by the Board in accordance with the provisions of Health and Safety Code Section 33213. Pursuant to Health and Safety Code Section 33213, the City and the Agency are hereby authorized to redevelop the County Area or any appropriate portion thereof, and to prepare a Redevelopment Plan for such redevelopment. The foregoing authorization is subject to the requirement that the Redevelopment Plan Must be approved by ordinance of the Board in accordance with the provisions of Health and Safety Code Section 33213 before the City or the Agency may exercise any redevelopment powers within the County Area other than the preparation and adoption of the Redevelopment Plan itself. This ordinance shall become effective 30 days after passage and, within 15 days of passage, shall be published once with the names of the supervisors voting for and against it in the Contra Costa Times, a newspaper of general circulation published in this County. We agree that the project as proposed will benefit the citizens in the area and the county. The information supplied to our staff indicates that 2/3 of the project costs will be targeted to areas currently unincorporated. Our understanding of the project is presented in the attachments as provided by city staff. Also, we agree to this ordinance with the understanding that the property tax and other revenues generated in the area would be distributed based on the parameters below. 1. The existing property tax sharing arrangement will not be changed until fiscal year 1992-93. 2. From fiscal year 1992-93 until .fiscal year 2002-2003 , the county will defer its normal increment except for the 2% annual inflation increment. The Fire District will receive a 100% pass through during the entire redevelopment project. 3. Beginning in fiscal year 2003, the county will be repaid for the increment deferred with interest, according to the average local agency investment fund rate for each year during this time period. The annual payment should be approximately 130% of the normal annual county increment. 4. Beginning in the year in which the accumulated deficit has been eliminated until the end the project, the county will receive its normal annual increment. f -2- 5. The amount of sales tax and pipeline franchise revenue generated in the unincorporated area has not been determined. If this revenue is significant, the county expects reasonable offsets to .mitigate the revenue loss. The Board is requesting that your Council accept this letter and confirm this agreement.
