Accept report from Health Services Director regarding Contra Costa County Emergency Medical 'Services Fund, Physician Reimbursement Rules. 2. Authorize Health Services Director to notify Contra Costa County physicians of the availability of the Emergency Medical Services Fund and of the "Rules" for filing claims. 3. Authorize Health Services Director to begin making payments as of February 1, 1990 as provided for in the above referenced "Rules". FINANCIAL. IMPACT There is $161 ,067 in the Emergency Medical Services fund which is designated for Physician Reimbursement for the period September 1, 1988 to June 30, 1989. BACKGROUND On June 21, 1988, your Board adopted Resolution No. 88/371 which established an Emergency Medical Services Fund as provided under California Health and Safety Code, Chapter 2.5, Part 1 , Division 2.5 (commencing with Section 1797.98a) as added by Chapter 1240 (Statutes of 1987) . On September 1 , 1988, pursuant to Penal Code Section 1465, the Courts of Contra Costa County began collecting an assessment of one dollar ($1) on every ten dollars ($10) on fines, penalties, or forfeitures imposed and collected for certain criminal offenses. Further, on June 21 , 1988, your Board directed the Health Services Director to develop a plan for implementation and disbursement of the Emergency Medical Services Fund. On December 6, 1988, your Board adopted Resolution No. 88/746 which, pursuant to Penal Code Section 1465 as amended by Senate Bill 612, Chapter 945 (Statutes of 1988), increased the assessment from one dollar to two dollars ($-I). The collection of the increased assessment began on January 1, 1989. As provided under SB 612, 58% of the monies collected for the EMS Fund is to be used for reimbursing physicians who provide emergency medical care in general acute care hospitals to patients for whom no payment is received. The Health Services Department has drated and County Counsel has approved the procedures and criteria for reimbursing physicians who have provided such services. Procedures and criteria are contained in the "Contra Costa County Emergency Medical Services Fund, Physician Reimbursement Rules". Thereafter, reimbursements will be made on a quarterly basis. The longer initial reimbursement period is to compensate for the fact that collections during the early months were lower (fines collected during that time were often for offenses which occurred prior to the Fund implmentation date). SB 12/612 require the physician to attempt to collect for these services from the patient and all possible third party sources for six months. The initial reimbursement period is September 1 , 1988 to June 30, 1989; therefore, the Health Services Department will begin accepting claims after December 31, 1989 for services rendered during this period. If claims exceed the amount available in the EMS Fund for physician reimbursement, the $161 ,067 will be distributed on a pro rata basis. The Department will report back to your Board when plans have been developed for allocation of the remaining monies in the Emergency Medical Services Fund. This is being coordinated with the allocation of AB 75 funds.
