SUBJECT: DELTA PROTECTION ACT (SB-34) : IMPLEMENTATION, LEVEE ENGINEERING AND
HABITAT CONCERNS, COUNTY CLEARANCE PRIOR TO RECLAMATION DISTRICT
OPERATIONS, LEGISLATIVE DELEGATION APPRAISAL RE USE OF FUNDS
SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Direct the Community Development Department to prepare a
report on levee engineering activities (ie. the loading of
levees with additional materials in rehabilitation efforts) as
part of the SB-34 Delta Flood Protection Act operations.
2 . Direct the Fish and Wildlife Committee to report to the Water
Committee in regard to specific habitat concerns (associated
with vegetation removal and other operations) during SB-34
levee rehabilitation operations.
3 . , Direct County Counsel and the Community Development Department
to investigate the issue 'of required County clearance prior to
reclamation district levee work.
4 . Authorize Chair to sign a letter to the County legislative
delegation 'regarding their assessment as to how funds
generated for SB-34 delta levee improvement are being used.
5. Direct the . County Administrator to report to the Water
Committee regarding legislation to reestablish the Sheriffs
Marine Patrol, how the Fish and Game Code empowers the Marine
Patrol, and, the potential for protection of fisheries and
habitat in addition to boater safety through Marine Patrol
operations.

BACKGROUNDIREASONS FOR RECOMMENDATIONS
1. The Delta Flood Protection Act (SB-34) , passed by the
legislature in March, 1988 created the Delta Flood Protection
Fund and appropriations for $12 million annually for 10 years,
beginning in 1988. Six million dollars is allocated for local .
assistance under the Delta Levees Maintenance Subventions
Program, and $6 million for Special Flood Control Projects.
The loading of additional materials onto levees for stability
has long been an engineering concern due to fragile underlying
peat organic soils in many areas. As more material is added
onto levees,, peat soils compress, and may begin to slip or
crack. Sherman Island levee problems are the most recent
example of this phenomenon. Severe water quality problems
could be the result of a levee break, therefore levee
rehabilitation projects must be undertaken with extreme care.
As large scale levee rehabilitation will take place under SB-
34, the Water Committee recommends an inquiry as to methods to
be used in rehabilitation efforts.
2 . It has been brought to the attention of the Board on several
occasions (most recently Quimby Island) , that during levee
maintenance/rehabilitation operations vegetation on levees is
often destroyed. The Department of Fish and Game is currently
working with the Army Corps of Engineers on a no net loss
program to minimize and mitigate loss of habitat during SB-34
levee rehabilitation programs. However, historically, the
Department of Fish and Game has had limited input into Corps
levee operations. For this reason, the Water Committee
recommends that the Fish and Wildlife Committee compose a
specific list of habitat concerns as they relate to levee
construction operations, and submit to the Water Committee for
further review and disposition.
3 . During the last Water Committee meeting, the issue of County-
required clearance of reclamation district operations was
brought to the Water Committee's attention. It was the view of
this individual that a law may exist whereby County clearance
is required. The Water Committee recommends that County
Counsel and the Community Development investigate this
possibility:'
4. Several questions have arisen in regard to the use or non-use
of funds slated for levee rehabilitation as part of SB-34.
Some assessment of how funds generated through SB-34 are being
utilized is requested of the legislative delegation.
Assemblymen ` Baker and Isenberg, and Senator Boatwright have
all had input regarding sponsorship and funding of this
legislation, therefore their assessment as to current status
and use of funds is recommended by the Water Committee.
5. Due to positive voter reaction to a measure recently placed on
the ballot regarding the Sheriffs Marine Patrol, the Water
Committee wishes to ascertain the current status of
legislation ,to obtain funding for marine patrol operations. In
addition, the Water Committee requests additional information
regarding Marine Patrol potential for further Fish and Game
Code enforcement, as a method for protection of fisheries and
habitat in addition to boater safety duties.
