McPeak ABSTAIN: None --------------------------------------------------------------------- --------------------------------------------------------------------- SUBJECT: Hearing On Appeal By Herbert And Barbara Herman On Request By Vaquero Land Company, Subdivision 7345 , Byron Area. This is the time heretofore noticed by the Clerk of the Board of Supervisors for hearing on the appeal by Herbert and Barbara Herman (appellants) from the decision of the East County Regional Planning Commission to deny the request by Vaquero Land Company (applicant and owner) to subdivide 105 acres of land into 9 units (Subdivision 7345 ) in the Byron area. Mary Fleming, Community Development Department, presented the staff report, describing the proposed subdivision location, the access to the various parcels, and commenting on the negative declaration. She commented on the staff recommendation for approval of the subdivision, the 'Planning Commission concerns and reasons for their denial of the subdivision. She advised the Board of the staff recommendation that the Board accept the environmental documentation as being adequate, deny the appeal and uphold the decision of the East County Regional Planning Commission. Supervisor Torlakson requested clarification of the original staff recommendation and compliance with the General Plan and the ranchette criteria. Ms. Fleming responded to Supervisor Torlakson' s request. The public hearing was opened and the following person appeared to speak: Herbert E. �Herman, 40329 Paseo Padre Parkway, Fremont, presented various material to the Board for consideration, and commented on the materials before the Board. Supervisor Torlakson commented that he would like to defer the matter to meet with staff and the applicant, to inquire as to the Planning Commission' s reasons for denial, and to consider the testimony given today. Supervisor Torlakson moved to close the hearing. The Board voted unanimously to close the hearing. Supervisor Torlakson moved to set the matter for decision. Victor Westman, County Counsel, advised that the hearing should be reopened and continued to January 15, 1991. Supervisor Torlakson moved to reopen the hearing. and to continue the hearing to January 15, 1991 at 2 : 00 p.m. IT IS BY THE BOARD ORDERED that the hearing on the above appeal is CONTINUED to January 15, 1991 at 2 : 00 p.m. 1 hereby certify that this Is a hue and correct copy of an action taken and entered on the minutes of the Board of Sup,�visors on th date shown.
