SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS That the Board of Supervisors introduce Ordinance No. 90- 120 , which permits the county to employ private entities or persons on a temporary basis to perform subdivision map reviews, waive reading and set forth date for adoption of same. BACKGROUND/REASONS FOR RECOMMENDATIONS . In April 1990, the Board expressed an interest in providing the ability to 'accelerate the land development processing for those applicants willing to pay additional fees. Due to the cyclical nature of application submittals for land development projects county staff is sometimes unable to process applications as quickly as is considered desirable. Staff, at best, remains constant and is often reduced for some period of time through attrition and a delay in refilling the positions. In order to provide the best service possible to applicants, staff recommends approval of the Ordinance Authorizing Additional Subdivision Map Processing Services. The ordinance would allow the Community development Department to contract with a private firm to provide project review ser ices 'n a more rapid fashion that if processed by county staff. SUMMARY. This ordinance amends the County Ordinance Code, pursuant to the authority found in the Subdivision Map Act (Gov. Code, S 66451. 1(b) ) , to permit the County to employ private entities or persons on a temporary basis to perform additional subdivision map reviews. SECTION 2. Section 92-10.006 is added to the Contra Costa County Ordinance Code to read: 92-10.006. Map check by private entity: special checking fee. (1) At the time a subdivider files an application for a tentative subdivision map with the Community Development Department, the subdivider may request that the Department estimate the time required to check the map based on the current workload and staffing level. If the subdivider desires faster processing of his or her map, he or she may request that the County contract or employ a private entity or persons on a temporary basis to process the tentative map and provide a recommendation for the decision-making body. The County need not enter into such a contract or employ such persons if it determines either that (a) no such entities or persons are available or qualified to perform such services, or (b) the Department staff would be able to perform such services in a more rapid fashion than would any available and qualified persons or entities. (2) Any such entity or persons employed by the County shall, pursuant to an agreement, perform all functions necessary to check tentative maps and to comply with other requirements imposed pursuant to the Subdivision Map Act and this title, except those functions reserved by this chapter to the Director of Community Development or the Board of Supervisors, including the approval or denial of such maps. (3) The subdivider shall pay a special premium fee in an amount necessary to defray costs directly attributable to employing or contracting with entities or persons performing services pursuant to this section. The premium fee shall be in addition to the application fees established by the County. (4) The director of community development is authorized to enter into and sign, on behalf of the County, agreements with subdividers and with entities and persons to carry out this section. SECTION 3 . EFFECTIVE DATE. This ordinance becomes effective 30 days after passage, and .within 15 days of passage shall be published once with the names of the supervisors voting for and against it in the a newspaper published in this County.
