FINANCIAL IMPACT It is anticipated that revenues will increase for the 1990-91 fiscal year. REASONS FOR RECOMMENDATION / BACKGROUND Assembly Bill, 2164 , Statutes of 1989 allows a judgment debtor to pay the judgment of a small claims court to the court in which the judgment was entered. The court would then be required to remit the payment to the judgment creditor. The bill allows the Board of Supervisors to set a fee, not to exceed the actual costs of administering theiprogram, up to a maximum of $25, which is paid by the judgment debtor. The Municipal Courts has determined that the costs of administering judgment debtor payments exceeds $25 (reference attachments) and, therefore, request that the administrative fee be set at the maximum amount. CONSEQUENCES OF NEGATIVE ACTION If the judgment debtor fee is not established, the Municipal Courts will be required to carry out the program, but will be unable to recover its costs ' for doing so.
