HomeMy WebLinkAboutMINUTES - 11061990 - 1.38 1-035 TO: BOARD OF SUPERVISORS Y Contra FROM: Costa Phil Batchelor, County Administrator x , s County DATE: November 1, 1990 rTA�oUx - SUBJECT: LEGISLATION TO INSURE FULL REIMBURSEMENT TO COUNTIES FOR ALL STATE-MANDATED COSTS TO IMPLEMENT, MAINTAIN AND UPDATE THE "TANNER" HAZARDOUS WASTE MANAGEMENT PLAN SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: Direct the County, Administrator to include in the County' s 1991 Legislative Program a proposal calling on the County Supervisors' Association of California (CSAC) and League of California Cities to sponsor legislation providing for full reimbursement to counties for all state-mandated ' costs associated with the implementation, maintenance and on-going administration of the Hazardous Waste Management Plan as has been recommended by the Hazardous Materials Commission and the Association of Bay Area Governments (ABAG) . BACKGROUND: As the Board of Supervisors is aware, the County has prepared and submitted to the State Department of Health Services a Hazardous Waste Management Plan (Tanner Plan) as is provided for in State Law (AB 2948, Chapter 1504, Statutes of 1986) . The original legislation appropriated $10 million to assist counties to pay for the cost of preparing the Hazardous Waste Management Plan. That money, while greatly appreciated, did not even cover this County' s costs of preparing the Plan. This County has one of the few Tanner Plans which has been approved by the State. It is now consuming a large amount of time to implement the Plan, and educate the community and businesses to the requirements of CONTINUED ON ATTACHMENT. As applications for facility siting begin to be processed the review and decision as to whether an application is consistent with the Tanner Plan will require time. The staffing of the Hazardous Materials Commission requires time. In three years it will be necessary to update the Tanner Plan and have it readopted by the cities and the Board of Supervisors. All of this work is currently 100% a county expense because there is no longer any funding available from the State. At its last meeting on October 22, 1990 the Hazardous Materials Commission voted to recommend to the Board of Supervisors that it ask CSAC and the League of California Cities to sponsor legislation which would provide some mechanism by which the counties could fully reimburse themselves for all state-mandated costs associated with the implementation, maintenance and updating of the Tanner Plan. At the last meeting of the ABAG Hazardous Waste Management Facility Allocation Committee the Committee also voted unanimously to recommend that each city and county in the ABAG region adopt a position . requesting the State Legislature to enact legislation that will identify a dedicated, on-going source of revenue for the planning, implementation and update of county and regional hazardous waste management plans. Staff was asked by one of this County' s representatives to the Facility Allocation Committee, Councilwoman Rosemary Corbin of Richmond, to forward this recommendation on behalf of ABAG to the Board of Supervisors. We are, therefore, on behalf of the Hazardous Materials Commission and the Association of Bay Area Governments, recommending that . the Board of Supervisors direct that such a proposal be included in the County' s 1991 Legislative Program which we hope to return to the Board of Supervisors on November 27, 1990 . cc: County Administrator Larry Naake, Executive Director, CSAC (Via CAO) Don Benninghoven, Executive Director, League of California Cities (Via CAO) Suzanne Larson, Staff to the ABAG Facility Allocation Committee (Via CAO) Hazardous Materials Commission (Via CAO) Hazardous Materials Council (Via CAO)
