THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Resolution on November 6, 1990 by the following vote:
AYES: Supervisors Powers, Schroder, McPeak, Torlakson and Fanden
NOES: None
ABSENT: None
ABSTAIN: None RESOLUTION NO. 90/728
SUBJECT: Completion of Improvements, Subdivision MS 78-89, Oakley
Area.
The Public Works Director has notified this Board that the
improvements in Subdivision MS 78-89 have been completed as
provided in the Subdivision Agreement with Herbert C. Lorenz and
Diane A. Lorenz heretofore approved by this Board in conjunction
with the filing of the Subdivision Map.
The Public Works Director having also notified this Board that
Herbert C. Lorenz and Diane A. Lorenz, subdividers, have requested
an eighty-five percent performance bond reduction for the duration
of the warranty period.
NOW THEREFORE BE IT RESOLVED that the improvements have been
COMPLETED as of October 15, 1990 thereby establishing the six-month
terminal period for the filing of liens in case of action under
said Subdivision Agreement:
BE IT FURTHER RESOLVED that the $4350 cash security for labor
and materials (Auditor's Deposit Permit No. 173815, dated May 24,
1990) deposited by Diane A. Lorenz be RETAINED for the six-month
lien guarantee period until April 15, 1991, at which time the
Public Works Director is AUTHORIZED to refund the cash security
less the amount of any claims on file.
BE IT FURTHER RESOLVED that. the beginning of the one year
warranty period is hereby established, and that fifteen percent of
the performance bond, $1305 (Auditor's Deposit Permit No. 173815,
dated May 24, 1990) made by Diane A. Lorenz be RETAINED for one
year pursuant to the requirements of Section 94-4.406 of the
Ordinance Code.
BE IT FURTHER RESOLVED that the Public Works Director is
AUTHORIZED to refund $6395 of the $7700 cash security for
performance (Auditor's Deposit Permit No. 173815, dated May 24,
1990) plus interest in accordance with Government Code Section
53079, if appropriate, to Diane A. Lorenz pursuant to the
requirements of the Ordinance Code.
BE IT FURTHER RESOLVED that the Public Works Director is
AUTHORIZED to refund the $1000 cash deposit (Auditor's Deposit
Permit No. 173164, dated May 10, 1990) plus interest in accordance
with Government Code Section 53079, if appropriate, to Diane A.
Lorenz pursuant to the requirements of the Ordinance Code.

RESOLUTION NO. 90/728
