SUBJECT: Water-related Issues
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION
1 . Direct the Community Development Department to arrange a
meeting with the Hoffman Company, the State Department of
Fish and Game, the Army Corps of Engineers, the East Bay
Regional Park District_ and the Fish and Wildlife Committee
to verify compliance of development with wetlands protection
at the Big Break area in Oakley. After this meeting the
Community Development Department will report to the Water
Committee regarding this issue.
2. Direct the Community Development Department and the Fish and
Wildlife Committee to monitor the United Towing Wetlands
issue and report back to the Water Committee.
3 . Request the East Bay Municipal Utility District and the
Contra Costa Water District to do an assessment of the San
Diego Water Authority Water Reclamation ordinance to
determine applicability, and report back to a working
session of the Water Committee.
4. Direct the Community Development Department to alert
builders involved in the planning process to changes
proposed to the County Water Conservation Landscape
Guidelines.

REASONS FOR RECOM1ENDATION/BACKGROUND
1. The Fish and Wildlife Committee reported to the Water
Committee during the October 16, 1989, meeting that as part
of construction efforts for housing development, a
contractor inadvertently graded and filled approximately
four acres of wetlands in the Big Break area of Oakley. The
Committee felt that replanting the area with native species
suggested by the Community Development Department would not
be adequate mitigation to the filling. There is also
concern that some construction may also be occurring within
the filled area.
At the November 13 , 1989, meeting of the Water Committee,
the Community Development Department reported that staff had
contacted the developer, and was informed that the subject
fill had been removed and the area was re-vegetated. The
developer also indicated that repairs were completed to the
specifications of the Army Corps of Engineers and the State
Department of Fish and Game, and the names of agency
representatives were submitted to confirm adequacy of
repair.
2 . The area commonly known as the United Towing property is
located west of the Avon Refinery, to the west of and
adjacent to Pacheco Creek, and immediately north of
Waterfront Road. The area is presently unincorporated. The
Praxis Development Group owns the area, and has applied to
the City of Martinez for annexation, a General Plan
Amendment, rezoning, and has provided a development plan for
industrial use. An initialstudy has recently been
circulated for preparation of an Environmental Impact
Report. This site may contain endangered species, and a
portion of the site is comprised of wetlands areas. County
concerns relative to the proposed development are further
enumerated in the November 14 , 1989 , letter from the
Director of the Community Development Department to the City
of Martinez.
some grading of this site has occurred by the applicant for
the alleged purpose of weed abatement. On November 14,
1989, the County issued a Cease and Desist Order to stop
grading operations. Since that time, the applicant and the
County are under a verbal understanding that no more grading
will occur.
3 . The San Diego Water Authority has produced a comprehensive
Water Reclamation Ordinance, adopted by the City of San
Diego on July 24, 1989. The Water Committee has reviewed
this ordinance, and recommends that the Contra Costa Water
District and the East Bay Municipal Utility District assess
this ordinance for applicability to our County, and report
back to a working session of the Water Committee after the
new year.
The Board adopted a water reclamation policy on January 23 ,
1989, specifying that the potential for water- reclamation
use should be considered for landscape irrigation, dual use
systems, and on-site reservoirs in major new developments.
4. On July 24, 1989 , and October 24, 1989, the Board directed
the Community Development Department to work with County
Counsel on preparation of a Water Conservation Landscape
ordinance based upon revised landscape guidelines. A
preliminary draft ordinance was prepared and discussed at
the Water Committee meetings of October 16, and November 13 ,
1989. Agency comments were incorporated into the draft, and
the ordinance is now under review by County Counsel. As the
new landscape ordinance contains some changes from our
current guidelines, it was determined that builders should
be warned of these forthcoming revisions.
