Remove this item as a referral to our Committee and take no further action on this item. BACKGROUND- On September 19, 1989 the Board of Supervisors referred to our Committee the question of whether the County should make provisions of the State Building Code applicable to condominium buildings as it applies to requirements for handicapped access. On November 13 , 1989 our Committee met with the Director of Building Inspection to discuss this question. The Director of Building Inspection explained that while it' is true that the State Building Code requirements relating to handicapped access do not apply to condominium buildings, the County has interpreted the Code in such a way as to make its handicapped access requirements partially applicable to condominium buildings. Under the current state building code requirements applicable to apartments, all ground level units must be capable of being converted to handicapped accessibility without major structural modification, meaning that the wider doorways and other structural modifications have been built into each unit, even though all of the handicapped hardware such as grab bars may not have been installed. A condominium building is required to meet the handicapped accessibility requirements of the Uniform Building Code for a certain percentage of units. However, the Building Inspection Department does not require that all other units in the building be capable of being converted to handicapped accessibility. In view of the fact that this County exceeds the State Building Code requirements regarding the accessibility of condominium buildings to the handicapped, we see no need for further modifications to the County ordinances. Amendments to the State Building Code should be undertaken by county building officials if and when they see a need for such a modification. In the meantime, this County appears to be doing an excellent job of providing handicapped accessible units for those who require such modifications.
