By Ordinance 76-63 the Board of Supervisors has adopted the provisions of Government Code section 31641.04, permitting early retirement service credit. II . Because of an impending organizational change caused by changes in operational needs in the Sheriff ' s Department, and in order to achieve savings in money and other economic benefits for the County, the best interests of Contra Costa County will be served by permitting additional service credit for certain members of the Contra Costa County Employee' s Retirement Association (members) as follows: a. The provisions of this resolution are applicable to all members employed in job classifications of Captain, Marshal-Court Services Division, Director of Correctional Industries, and N.I .C. Resource Center Coordinator-Project, in the Sheriff ' s Department on November 29, 1989. (eligible members) . b. Every eligible member who retires between November 29, 1989 and January 5, 1990 shall receive two additional years of service credit for Contra Costa County service. C. Upon demand by the Retirement Association, the County Auditor shall transmit to the Retirement Fund the amount( s) determined by the Retirement Board to be the actuarial equivalent(s) of the difference(s) between the allowance(s) the eligible member(s) receive(s) after getting the additional service credit hereunder and the allowance( s) he/they would have received without such credit. d. On later re-entry into County employment under circumstances otherwise requiring or permitting membership in the retirement system, any member who has received additional service credit hereunder shall forfeit such additional . service credit, and the County' s payments hereunder shall be refunded, unless the re-entry is the result of a temporary call-back limited to a maximum of 720 hours of service in any one calendar year. e. Provided, nevertheless, that the provisions of this Resolution are not applicable; 1. To any member otherwise eligible if such member received any unemployment insurance payment within six months prior to November 22, 1989. 2. To any member if the member is not eligible to retire without additional �,S'�rvice credit under this Resolution. Captain (two retirements anticipated) B. Marshal (one retirement anticipated) C. NIC Resource Coordinator (one retirement anticipated) D. Director of Correctional Industries (one retirement anticipated) 2) Approve various personnel transactions to effect reorganization and restoration of Laboratory Services within the Sheriff' s Department; (P-300 ' s will be submitted to the Board at a later date) ; A. There is no net savings or additional costs for FY 90-91 which is the second year of the payoff to the retirement board. In FY 89-90, there is a small net increase in expenditure due to the payoff of vacation credits for the five individuals involved. This payoff of an existing liability will be absorbed in the Sheriff ' s budget in the current fiscal year. Reason for Recommendation The early retirement program in the Sheriff ' s Department allows the Sheriff to reorganize and consolidate the delivery of service and to reestablish the drug testing positions in the Criminalistics Laboratory which were eliminated by the budget cuts earlier this year . The cancellation of the Captain position will result in the merger of the Service Division into the Communications Division. This reorganization coincides with a recommendation contained in the civilianization study recently commissioned and received by the Board. The cancellation of the civilian Director position and the replacement with a Specialist position results in a significant cost savings by consolidating the functional duties of two directors under one remaining director. The cancellation of the NIC Resource Coordinator position provides the primary funding for the restoration of the two Forensic Toxicologist positions in the Criminalistics Laboratory. Finally, the last remaining Marshal classification is replaced by a Lieutenant position at a lower pay level. The one position whose incumbent is exercising the early retirement option and whose position will not be cancelled is the Captain for the new West County Facility. Clearly this position must be filled. Thus by cancelling four positions and replacing them with four positions with a lower associated cost the Sheriff is able to reduce the number of divisions in the Sheriff ' s Department and restore the critical laboratory positions. Background The Hughes-Heiss Civilianization Report presented to the Board earlier in 1989 recommended the elimination of the Captain in the Service Division. The action recommended above will accomplish this objective. The budget cuts required by the adoption of the 89-90 budget eliminated two of the four Forensic Toxicologist positions in the Laboratory, thus severely curtailing the ability of the Sheriff to do drug testing for agencies in Contra Costa County. Again, the action recommended above will reestablish those positions at a cost offset by cancelling management positions. Consequences of Negative Action Should the action recommended above not be taken, the county will have missed an opportunity to a) streamline and reduce the cost of county services and b) restore cuts made in the drug testing program of the laboratory.
