Justification
I. RECOMMENDATION
1. APPROVE the Consulting Services Agreement with Woodward-
Clyde Consultants (WCC) for the preparation of the Wetland
Mitigation Plan for the State Route 4 over the Willow Pass
Grade Project in an amount of $14, 464 . 00.
2 . AUTHORIZE the Public Works Director to execute the
Consulting Service Agreement with Woodward-Clyde
Consultants.
II. FINANCIAL IMPACT
No financial impact to Contra Costa County. An agreement between
the County and the San Francisco Bay Area Rapid Transit District
(BARTD) executed February 8, 1988 , provides that BARTD reimburse
the County for all costs incurred for the project development in
an amount not to "•exceed two million dollars ($2 , 000, 000. 00) .

III. REASONS FOR RECOMMENDATION/BACKGROUND
To relieve traffic congestion in eastern Contra Costa County, the
County has proposed widening and lowering a portion of Highway 4
extending from the Willow Pass Road interchange in Concord to the
Bailey Road interchange in Pittsburg.
The lowering of Willow Pass grade for the project will require
the excavation and grading of large quantities of material . As a
result, this proposed activity would impact approximately two and
one-half acres of wetlands. Currently, Highway 4 has a narrow
median, thus feasible alternatives to impacting the wetland areas
are not available. A preliminary delineation of the wetland
areas within the proposed right-of-way has been conducted by WCC
for Contra Costa County.
The wetlands which would be impacted by the proposed project are
potentially under the jurisdiction of the U.S. Army Corps of
Engineers (ACOE) , pursuant to their authority under Section 404
of the Clean Water Act. The regulations established under this
law require a permit to conduct development activities in
wetlands. In many instances, such as the Highway 4 project, the
ACOE require a mitigation plan before granting a 404 permit.
Thus, the purpose of the proposed scope of work is to develop a
plan to mitigate the impact on wetlands in the proposed project
area.
The item was heard by the Transportation Committee.
IV. CONSEQUENCES OF NEGATIVE ACTION
Failure to approve a Consulting Services Agreement with WCC will
result in a delay in project development, including environmental
clearance. This delay could ultimately result in the loss of
State funds for project construction.
